I am on week # 3 on my 5th week of LOA. I do not see how I will be able to return to my current job due to work that is required for me to have this job. It is a long story but I know that my current employer will make it very difficulty to return back..... The doctor might release me to return to work in 2 weeks. I would like to find employment else where after the doctor releases me. Does anyone know if it is required for me to come back to this job?

It is always best to inform oneself prior to making a decision that has implications for salary, job security and monetary obligations.

An employer can legally charge an employee for the cost of benefits provided during FMLA if the employee does not return to work in a benefits-eligible position at the conclusion of FML. Not all do, but they can. It would be best to get this information before making a decision.
