I am a Filipina nurse with a pending EB3 petition for the US. However, my petition was abandoned by my previous employer and I am currently in the process of "recapturing" or filing for a new petition from a new employer. My priority date is Nov 2006 and is already current to date.

I am engaged as of the moment and I would like to know if when is the best time for me to get married with the following considerations:

1. I would like my husband-to-be to follow to the US after 6months-1year (not immediately since I will still need to establish my career before I could support him)

2. How will we qualify under the "following to join" category?

3. If we get married before filing my new petition, granting that he will be issued a visa with me, what is the time frame for him? ( to follow to the US) does he need to accompany me or can he still stay and follow afterwards? If so, for how long?

4. If we qualify under follow-to-join, what is my time frame to file for his petition?

You need to discuss this with your lawyer but would suggest easier to get married before your interview. He doesn't have to follow straight away but does have 6 months to activate his immigrant visa

from my understanding you need to marry before pd is current,

that way u can follow to join petition

u need to file for him
