TX BON can't process exam application because of compact state

Do I have to hold a Texas address before they could process my application even I sworn and declare that I intend to practice in Texas? I feel like there's no hope for me and it's so frustrating and stressful...:cry: Your input and information will help me a lot... thanks!

No, you do not. I was living in a different state but I knew I was moving to Texas because of the military...so instead of getting a license in my home state, I opted to get my initial license in Texas to avoid endorsement fees and also for the fact that I wouldn't do anything with a nursing license in my home state at the time. When I applied to the TX, I used my home state's address...I didn't have to have a TX address. I just wasn't awarded a compact license because I didn't declare TX as my primary state of residence. When I moved, I submitted my address change to the TX BON and then they changed my license to a compact license.

I would call the TX BON for clarification...it sounds like there is something else at play here.

I've seen this before that you cannot apply for a license in another compact state if your primary residence is in a compact state. You would be able to work 30 days in TX with your NE license until you formally changed your primary residence and endorsed your license.

This seems to be new and is true for other compact states, from MD BoN: "Effective October 1, 2012, any Registered Nurse (RN) or Licensed Practical Nurse (LPN) applying for licensure and living in a member state of the Multistate Licensure Compact must take the NCLEX exam in their home state. The Maryland Board of Nursing is required by the Nurse Practice Act (Health Occupations, Title 8, Annotated Code of Maryland), to abide by the below regulations: 8-301(d) - A Registered Nurse (RN) or Licensed Practical Nurse (LPN) can hold a license in only one party state at a time and that license has to be issued from the home state of the licensee; 8-304(2)(iv)- An applicant for licensure by examination in Maryland must submit satisfactory evidence to the Board that the applicant’s primary state of residence is Maryland or a state that is not a party to the compact; and 8-305(b) An applicant whose primary state of residence is a party state, other than Maryland, is not entitled to be examined for a license as an RN or LPN in Maryland.Please understand that if the Board receives your application and you live in a Compact State, your application WILL NOT be processed and WILL BE returned to you."

It seems there would be no issue if you didn't live in a compact state. Try calling TX BoN for clarification. You probably wouldn't have the issue if you already had an NE license as you would be endorsing a NLC license to another NLC state. Since this is an initial license and you live in a compact state, perhaps if you contact the TXBoN and explain that your husband has a job offer in TX and that you will be relocating then they might make an exception with proof of your husbands job offer?

I am guessing the difference is that you did not already have an active application in your home state. The NLC rules specify that one can only be licensed in one compact state at a time, and the OP has already applied for licensure in Nebraska.

I agree the OP's best bet is to speak directly to the TX BON and ask them how to proceed. Perhaps withdrawing/discontinuing the application in Nebraska would fix the problem.

Thanks for all your replies! I just talked to a TX BON representative, they told they can't give me ATT until I change my address to Texas. My concern is if my application will be on hold because I already started processing all the requirements. The CES report cost $350 and I don't want to waste that money. She told me everything will proceed and be accepted which gives me a relief! She just can't guarantee if they will accept my explanation letter. Now I am just waiting what the board has to say and crossing my fingers that they will waive it and give me an ATT soon...

So has any one found out about getting the ATT letter without having a tx address? I live in canada and I am hoping this wont hurt my chances of getting a letter or if there is anything I can do to ensure I get a letter

the OP's issue is that her primary residence is in another NLC (nursing license compact) state. If the OP lived in CA, NY, NJ, PA, or any of the other non-NLC states it would be a non-issue.

I recently got my RN from Virginia license transferred to Texas (compact states). This was the most confusing, misinformed process I have ever gone through! I have had licensing in 6 other states. NOTHING has been such a nightmare. Please talk to more than 1person at TBON. I got different answers from each person. They lost three sets of transcripts from the school where I did my nurse refresher course. They misplaced items. They told me I HAD to take THEIR Jurisprudence class even though I had taken an accepted class. TBON was the most incompetent BON I have ever experienced. Be careful. Good luck.

I hear you because I experienced that in CA BON before the concurrency issues. It is so frustrating when you feel clueless what will happen next. Did you just recently endorse your license in TX? I'm still waiting for their reply and I'm hoping there will be no problem. I heard good stories in other threads though. If ever they can't accept my request I will just have to move and change my state of residency. Thanks for your concern :) Did you already get your license in TX?

That makes sense, considering the state I lived in prior to moving to TX was a non-NLC state. That must be why I didn't have a problem getting my ATT.

Yup! I'm still waiting what they'll say. My requirements are all received and completed last friday. Can I register in Pearsonvue now or do I have to wait for the eligibility letter first to do that?
