Last year (Feb 2003), i was misdiagnosed to have Hep C. A week after, I had the test repeated 2 times in a different hospital and it came out negative. Someone told me that i should have sued the hospital for emotional torment. Is it too late? I guess. Just want your input guys. Thanks.

So a week of emotional torment and now you want to sue.

I am almost speechless, but not quite. I think you should be thankful that the first test was a false positve and move on and try to enjoy your life.

You guys are absolutely right.

My husband was just telling me yesterday about a local lawyer who is advertising on TV for people that were prescribed Oxycontin and got addicted to it. Some kind of class action law suit thing. UNBELIVABLE!! I can honestly say that if my husband had not been prescribed Oxycontin that I think he would have committed suicide due to the intense pain he was in. Turns out he had broken 2 of his disc in his lower back. Yes he became addicted to Oxycontin but duhhhhh! what do people expect? long story short he had a disc trimming and kicked his Oxy habit in a matter of months. He was very grateful for the drug when he needed it. For the life of me I do not understand all these lawsuit things. I guess Im just naive. :stone

I can understand your frustration at being given a diagnoses that turned up false and it IS frightening.

I was told a mass in my neck was 99.9% chance of cancer and it had to come out. The doctor declined a preop biopsy and insisted on taking it out immediately. It was benign, but he took most of my thyroid gland so I must take thyroid meds and have bloodwork frequently for the rest of my life. I was angry too and thought about suing. Then I realized mistakes happen, people are human and sometimes wrong, and was the harm done really sufficient for me to start all this legal headache. I was glad I did NOT have cancer...my news (like yours) was good in the end. So I did NOT pursue legal proceedings; I let it go.

I just happened to mention this to 2 co-workers the other day, and this "suing" thing came up (from both of them). So, it just got me thinking.

But, I wasn't really planning on suing them, like what i said, this happened a year ago. I let it go and was thankful.

You should be on your knees thanking God you were given a reprieve and had a false positive....I wish that had been the case for me! Unfortunately, I was found to have Hep C after being stuck by a needle from an infant in the NICU. Its been about 10 years now, and symptoms are present. I'm sorry you felt emotional torment, but think of multiplying that torment X10 years....

You might also consider some of the alternative treatments that have some evidence supporting their use. I think that these might include licorice (Glycyrrihiza glabra), Liver extracts, Milk thistle (Silybum marianum), Reishi mushrooms (Ganoderma lucidum), Thymus extracts, and good old vitamin C. Many believe that diets high in fruits and vegetables are also helpful. You may wish to try and find a doctor open to integrating alternative approaches along with the latest clinical interventions to help you beat this disease.

Uhhh, careful with the herbal remedies. They are still potentially extremely hard on the body, especially kidneys and liver. Look to the current issue of Consumer Reports. They have an article on so called 'natural remedies'.

Herbal remedies are not, repeat, NOT harmless. Just because something is listed as "natural" it does not = safe. Botulism is natural. It's also fatal.

Anyone with a compromised liver whether it's Hep C or too much Tylenol needs to be exceedingly careful with medication.

This is not meant as a slam. But I see way too many people who come in because "I took my allergy medicine with my diet supplements and now my heart feels like it's swing dancing all over my chest".

You can sue anybody for anything that does not mean you will win.

First to even have a case you must beable to clearly demonstrate that real harm occurred as a direct result of the misdiagnosis.

Under our system of torts simply receiving the wrong med, wrong treatment, wrong diagnosis, or having a gauze pad sewn up inside of you is not ground for a suit. You must beable to clearly show that you suffered some real harm as a direct result.

So if I gave you the wrong dose or the wrong med and you did not suffer real harm you have no case.

You can still sue but an ethical attorney would not take your case.

I have a good friend who is a personal injury attorney. Who has told me this.

Get over yourself we all experience scares in life, and stress, and worry from wrong information.

Are you going to sue the next time some creditor or bank makes a mistake on your bill because you were emoationally distressed thinking you owed more than you did?

Any lawyer who makes it a practice to pursue these types of things finds himself sanctioned by the courts.

Some attorney is running TV ads here to call if "you or someone you love have been told you have diabetes after taking the anxiety drug Zyprexa".

Grrr!!! Not only is Zyprexa an antipsychotic but Type II DM is a KNOW and documented potential side effect (and is probably r/t weight gain also a known and documented s/e).

Good grief, the pharmacy slip on my stepson's RX even lists it.
