And now they support legislation over repeating right wing messaging while doing nothing. What is it about legislating that negates the presidential ownership argument? 

The Border Patrol Union endorsed Donald Trump in 2020 and attend Republican round tables like "The Impact of the Biden Border Crisis".   The position has long been that Biden created the border crisis and is responsible for it.  

In looking at how they behaved during Trump's time they were probably not as combative but not always a happy bunch.  They were against the use of the National Guard, they endorsed Democrats for the Senate, but for the most part seemed happy at Trump's side.

They did endorse the bipartisan border deal that was recently shot down.   I'm looking to what they have to say about it's failure.

Likely because it provided money to them for resources and more agents.  You're not going to see many unions go against that.

When they endorsed it, they also acknowledged it wasn't a particularly good piece of legislation.

I'll quote what he said.   I'm not sure they said it wasn't particularly a good piece of legislation.  He doesn't seem to be particularly upset it failed since there's not much information on him commenting on the failure even if it means less money for his members.

This is what he said:    "Since Joe Biden has been in office, CBP has averaged over 6,700 apprehensions per day and the vast majority of these illegal immigrants have been released under a policy known as catch-and-release. Approximately 60% of all border apprehensions are single adults, a good number of whom are military age men. The Border Act of 2024 will give U.S. Border Patrol agents authorities codified, in law, that we have not had in the past.  This will allow us to remove single adults expeditiously and without a lengthy judicial review which historically has required the release of these individuals into the interior of the United States.  This alone will drop illegal border crossings nationwide and will allow our agents to get back to detecting and apprehending those who want to cross our borders illegally and evade apprehension. While not perfect, the Border Act of 2024 is a step in the right direction and is far better than the current status quo. This is why the National Border Patrol Council endorses this bill and hopes for its quick passage,” said Brandon Judd, President of the National Border Patrol Council.

That's your characterization.  No matter, Republicans have decided that the man who lost the 2020 presidential election is in control of Congress just now, regardless of what we the people want.   We're just supposed to accept that, I guess.
