Rules for CNA's staying over until the next shift cna comes in

Published

What are the rules regarding a cna staying over until the next shift relief comes in? What if the current cna has worked 16 hours? Are they still required to stay over until the next cna relief comes in?

I've remained for 18 and 21 hours. The important thing is that the nurse initials your time card so that you are properly paid overtime. Of course, it makes sense that someone who has only worked 8 hours should be asked to stay over someone who has already been on shift for 16 hours. That is just plain common sense.

it will depend on the state and facility you work in. some state laws may address this or some facility policies may address it. i've worked at places that had limits on the number of hours one could work within a 24 hour period (fatigue, it's a safety issue) and how much off time was require in between shifts worked (so you could get some sleep, again a safety issue).

We can't keep the cna's over 16 hrs. It against the law.

That's our law too and that's more than enough.

We do doubles (16) sometimes, but it is always by choice. If one of the oncoming PCT's calls off or doesn't show up, it is staffings problem. We are NOT ever required to stay past our scheduled shift. Lots of times we will stay to help out until backup arrives from elsewhere, but we are not in any way required to do so.
