Now, retrogression started. How long this will stay? In my case, I 140 will be submitted next week only. How long I may have to wait? Pls help.

As said, both houses must approved it and have Bush sign it to become a law.

The No Visa Cap for RNs and PTs provision is only a part of The Comprehensive Immigration Bill (Senate version only) and their are 2 versions of the bill: the Senate version and the Lower House Version. They have to be reconciled first because they do not agree on some provisions before a "Compromised" bill from the 2 versions is handed over to the Pres. for signing.

However, people are really finding ways for the reversal of retrogression. You may read the link w/c pinoy_guy posted above and there might be a chance that it will be cured by Dec. ( a band-aid solution ) instead of waiting for the above w/c will be taken up again only after the elections.

It's really confusing but the good thing is that people are really trying to find ways by using diff. routes.

If you're doing consular processing, you're employer can continue to file your petition and it will be processed up to the National Visa Center but not be interviewed in the U.S embassy until the retrogression is resolved. So, just let a reputable employer file a petition for you.

Impt. thing is don't rush on signing w/ an agency you are ambivalent on signing with from the start if they are saying that you have to file before Nov. because USCIS will still accept filing via CP even w/ retrogression.

"Pending Adjustment of Status applications for Nurses and Physical Therapists in the United States will remain pending until additional immigrant visas become available (unless the I-140 was filed before October 1, 2005). The Nurse or Physical Therapist will be able to remain in the United States and eligible to obtain employment authorization during this time."

My I-140 was filled in June 2005, approved in June 2006 originaly consular processing, now I want to switch to AOS and fill I-485.

I am realy confused if I am hit by retrogression or not. Does anyone know the answer. Thank you!

Hi!! I received a letter last July3 from NVC that they have received an immigrant visa petition filed by my employer. Is that already my packet3? Will I be affected by the retrogression since the cut off date is Oct.1? Would very much appreciate for a reply. Thanx!!!

yeah everything was filed like the 140, 145, etc.. i got the receipt from INS already..... dont know what will happen next

i mean i already submitted my visa screen with the lawyer... by the way, could you please let me know of the response of your lawyer? thanks..... share itto us.... and, lastly, are you also here in LA?

My lawyer said that if everything was sent and received before Nov. 1st, there is still a good chance to get EAD soon, although the I-485 will be approved until the visa number is available. I think this is ok with people who are filing for AOS.
