  1. I was able to avoid HPRP by getting an evaluation done by one of their approved evaluators before my case went to the Board of nursing I was not eligible for HPRP and my license remained active the entire time I was under investigation I never had it suspended
  2. Are you union at your hospital? That can help. Ultimately if they're at will they could fire you but from what I've read up on most hospitals will work with if your in HPRP. You're being monitored and drug/etoh tested a lot so you're proving your safe to practice
  3. Sounds like you did everything right! It takes a long time for the BON to "catch up" you might get placed on probation for a year which is basically where your manager fills out a simple form that that's your preforming safety every 3 months. Best of luck! Remember this feels like the worse day of our professional career but for them it's just another Thursday. Soon this will be behind you!
  4. Get another job asap. Show you have a god track record with your new job. It takes months for the BON to launch an investigation. Don't smoke any weed even if on vacation where it's legal. They could test your hair and that can show 3 months worth of drugs. Don't pay that lawyer. I hired Chapman law who also is FL. (I'm in MI) they didn't do anything to help but took 3k then I fired them and represented myself and had my charges dropped

  6. Hi, Does anyone have dual licenses in Canada and the USA and have been disciplined? Can the BON in the USA contact the Canadian BON and report any issues?!
  7. In the beginning I hired a lawyer who asked for $3500 which I paid, they nickeled and dimed me for everything then wanted more when the initial retainer was spent. Told me I’d never get my diversion charges dropped. So I fired my Lawyer and reached out the the assistant attorney general assigned to my case told my side of the story with my proof and they dismissed my charge. I still have a black mark on my license for “violation of general duty” for my poor documentation which I take accountability for. The best advice I’d tell anyone facing their BON or HR. Never admit to anything b/c they are always looking for a scapegoat to take responsibility off them. Also, if anything is narcotics related get a hair follicle test ASAP. even if you have a substance abuse problem these monitoring problems are not there to help with recovery they are only there to protect the public.

  9. Hey! I had my eval last week. I had waste discrepancies and my charge with the state BON was dismissed but part of my consent agreement was to get an eval, I’m in MI their monitoring program is similar to FL. It was actually pretty generic, my drug tests have always been clean since two years ago when this all happened, I just hear horror stories of programs
  10. So I was able to have my diversion charge dismissed! But since my administrative complaint involved narcotics I am required to have a substance/ mental health eval, can anyone please give advice to what that ask?

  13. I ended up firing my lawyer and negotiated a better deal with my States Assistant Attorney General. It honestly depends of the situation. Pm me if you wanna chat!
  14. DO NOT voluntary self report to hprp. Once you do, they own your life. Instead, get a substance abuse eval done to prove you do not have a problem. You can PM me I’m also in MI
  15. Open a credit card, do what ever you can to prove you don’t have drugs in your system. You don’t want to end up in monitoring.

    Keep working. Smart to get a drug test. Do not self report to a monitoring program. The BON isn’t definitely not your friend. Also, do let your lawyer scare you into keep paying them. I ended firing my lawyer b/c they weren’t willing to fight my diversion charge. I contacted the assistant attorney general myself and had my charges dropped. Every case is unique but you can do a lot on your own as well. I’d keep getting drug test every 3 months to show you’re not under the influence. Ultimately you have to prove to the BON you’re safe to practice. You can even do additional CE’s on proper waste/documentation to submit you took the intuitive to continue your knowledge. That’s the type of stuff the BON wants to see. And as far as your former employer. let it be a lesson learned they will throw you under the bus to protect themselves so will your co-workers
  18. It just should be a reminder that you are not friends with co-worker, but just that. I was accused of diversion, and literally 2 nurses reached out to me after I’d been working there almost 5 years. My charges were dismissed and I’ll never befriend a co-worker again for the rest of my career
  19. What State are you in? If you don’t want to disclose I completely understand. Im in MI and usually you see state or federal charges if it’s large quantities of controlled substances being diverted. But just to the south in OH they will try to throw the book at you for it. Every State is different.
  20. You’re not going to jail. Was it only 1 vile? If charges are brought you’ll definitely need a lawyer to attempt to get the charges dismissed especially if you’re in a rehab/monitoring program. The issue with Federal charges is the possibility of loosing the ability to work at a facility there accepts Medicaid/Medicare. It basically prevents you from working anywhere. May I ask what State are you in? Do not talk to co-workers, the state investigator will be talking to everyone that worked that night. It’s sad but unfortunately most will turn their back on you or throw you under the bus especially the hospital. you will get through this I promise. There’s lots of love and support on here!
  21. I would deny drug diversion and fight that it was a documenting error. When I had my interview with the investigator my stupid lawyer didn’t even say a word. He was just on the call.
  22. I’d call a lawyer that specializes in dealing with Licensing. Ask if they offer free consultations. What did the health department investigator ask? Did you tell they you took it upon yourself to take a drug test?
  23. You are not going to jail. This isn’t a criminal case unless you were contacted by your city’s district attorney. I’ve only seen criminal charges when like hundreds of narcotics are missing. You can not avoid the investigator but no not admit anything as far a diversion. and they are definitely not your friend anything you say will be held against you keep your answers short. They have most likely are ready had their investigation with your employer and co-workers. I’m in MI. Usually the next step is they forward there’s findings after your interview to the Nursing board to determine if you’ve violated States nursing code
  24. HPRP is very expensive. You have to pay for drug testing, addiction specialist, therapy, and attend AA/NA for 3 years. If your on probation for diversion it’s hard to get work. I’ve heard Divita is hprp friendly. The cost of the eval is $850.
  25. I’m in MI our Monitoring program charges $850 for an eval. I reached out to a few private addiction doctors and they want between $600-$800. It’s better to go with a private practice doctor vs the States evaluator b/c they will definitely twist your words and use it against you to sign a contract. The goal is to deny deny deny. If you have a negative drug test I’d never admit to having a problem. I wouldn’t even say I have a glass of wine after a hard shift b/c it implies a unhealthy coping mechanism. Also, with mental health I would be careful to say that working during this pandemic has caused extra stress. They basically want to get to say anything that could be used against you. Best of luck.
