I got fired!

I recently was terminated from my position as a Dialysis nurse. They did me dirty. I was accused of doing the very thing I had written an aide up for. Nothing happend to her but I was fired. I am devastated! Anybody out there experienced a unfair termination?

What did you write the aid up for and what was the reason they fired you? Sometimes you can sue. I imagine they were doing it to cover themselves? You will most likely find a better job elsewere.

During dialysis trmt q 30 min safety checks are required including vitals, pump speed, amt removed and various machine settings. During rounds I noted that the aide X had not charted for over a hour. I reminded her of policy. I looked at her trmt sheet shortly later and she had gone back and filled in the blanks. Vitals are the only thing she could have retrieved from machine. I wrote her up for false documentation. She was pissed! 5-6 weeks later it happend again and I wrote her up again. Nothing happend. Approx. a month ago another aide was also written up for false documentation and he was suspended. Then I was accused of false documentaion and was fired! They both were a different race and I know the administrator always feared a complaint concerning the NAACP. I'm thinking reverse discrimination.:angryfire

Please be absolutely sure of your facts prior to initiating a lawsuit. A licensed nurse is held to a higher standard than a CNA.

Discrimination does not seem to be an issue here. Either you falsely documented patient care or you did not. If you did not then you have a case against the facility. The race of your coworkers is irrelevent and should not be brought up. It only makes you look like your fishing to put the blame and focus elsewhere. Focus only on your specific situation.

It certainly is an issue if the aide was not discplined due to HR's fear of a discrimination lawsuit. And it is definitely an issue if the nurse was terminated as a means of shutting her up.

But this may be difficult to prove. This may be a situation where the OP is better off cutting her losses. If she has former co-workers at the facility who can vouch for her and if the rest of her work history is solid, she should be able to find another job.

OP: Make sure you file for unemployment. You may want to talk to an atty. who specializes in employment law. Most will give you a brief consultation without charge. Who knows? Your former employer may have skeletons in the closet.

Thank you for your replies. I did not falsify anything. What happend was I started to chart my "charge rounds" and was called to the phone. While on phone aide X took the trmt sheet off the machine to make a copy of it. I returned to finish my note(all I had written was "charge rounds") and the sheet was gone. I went on to another pt and then it suddenly appeared. I finished my note using the current time since that was the time I actually spoke w/pt and checked machine. X was not even assigned to this pt. She went out of her way to do this. Anyway she turned in 2 copies of trmt sheet. The one that said "charge rounds" with no time and a copy of the completed sheet w/the time and entire note. This was considered false documentation. I was unable to explain any of this when I was fired. I could not speak. Only cried and vomited.

So you were fired because the documentation was falsified; it just wasn't you who falsified it? Seeing as how you weren't able to explain anything when they called you in, I'm not sure you have any basis at all for a lawsuit.

I have no idea about legal reprecussions you could bring however from the

sounds of it you are far better off for not working there --

It sounds to me also that you were set up. Sorry, this happened. I say, just take this as a learning experience to take your paperwork with you when you leave to go do something else. If they fired you over that and just like that, doesn't sound like a place one needs to work at. Just get your resume and look elsewhere, there's something better out there for you.
