@Nurselee22 it sounds like you are going to be fine. I would t be surprised if at some point you get called to go in front of the board. (Which is now just a phone meeting in most cases) It took them over 3 years to get to my case and I was actually in the program AND got charged and convicted. However I did the peer assistance program and was able to get a job and eventually get my license off probation even with two misdemeanor convictions. But in your case I think the BON will just say your license will remain free and clear because they have no evidence of anything. They make say do a medication safety course or something. But I don't think you have anything to worry about. I've never seen them take action on a license for that. And I heard some CRAZY stories when I got called in front of the board. LOL

My case manager for the nursing program side of things was the one who determined what I had to do. She had me do a hair follicle test and I wasn't having withdrawals so she didn't make me go to any sort of rehab. I think most of the time they do require at least IOP though. If you need to do inpatient detox they'll determine that.

I got caught and fired Sept 2018. Immediately entered my states program for nurses. I'm in Indiana. I heard from a investigator regarding possible charges at the end of October 2018 and got charges filed December 2018. I would think that you would have already heard something if they were going to file charges. My place of employment turned me into the attorney generals office who did the investigation. Fingers crossed no charges for you!! It's much easier without the criminal aspect to deal with. Hard enough as it is. I graduated the program in 2021 and had my license taken off probation last year. Thank GOD!! It's hard but we get through it if we stay clean. (Charged with 14 felonies and took a plea deal for 2 misdemeanors and probation for 1 year, no jail time) Don't be scared, everyone's case is different. I never had to stop working, I got really lucky. They didn't even make me go to rehab just meetings and the program and probation.

@Surgerynurse if I were you I’d get ahead of the game and try to get enrolled In Your states recovery program for nurses because the board will eventually require that and it could drag out for a long time. You may not go in front of them for some time and I think it’s best not to drag out the process.

@Surgerynurse hey there! So my employer filed a complaint with the board who forwarded it to the attorney generals office who then investigated the claims. They researched all my charting and Pyxis records, they decided to file charges. So basically it was the state of Indiana that filed charges against me. I did not get a lawyer I got a public defender. Charges were filed about 3 months after I got the complaint from the AG office. They initially asked me to respond with my statement which I did. They then continued the investigation. (An investigator wanted to speak with me which I declined bc I did not have representation).

@nurselori22 you aren't crazy! If you are only on OIG for the losing the license you can asked to be taken off as soon as they reinstate you. And if not once you get your license I know plasma centers are REALLY monitoring friendly and don't accept any insurance.

@hppygr8ful I've already been sent a letter stating they are considering excluding me (due to a misdemeanor for obtaining a narcotic by fraud or deceit) and asked me to send in info that I want considered before making a decision. This was early August and I haven't heard anything yet so I'm wondering how long it takes them to decide.

@Indiana Im not sure why either but at this point its been almost a year into my contract and I haven't worked around them so I would have satisfied that stipulation.

@mississippiRN71 Its all going to be okay. I doubt if you will be suspended. I think you definitely want an attorney to argue the fact that you were not contacted for 3 years. Worse thing they could do if make you do monitoring. I don't believe they will suspend you due to the fact that you have been practicing for 3 years and at this point it makes them look stupid. You self reported like you were supposed to, you did your part. I really hope you don't even have to do monitoring because I think its ridiculous after all this time. If you have proof of treatment and can get your boss, coworkers, therapist, sponsor, or anyone else that may be able to give a character reference I would have that ready too. I honestly believe that at this point for you its all about whether or not you want to do monitoring. If you don't I would fight it if you have proof that you have been clean this whole time and they let you renew twice. I got into it immediately because I knew it was coming either way and I wanted to do anything I could to fix my mistakes. Im not even sure you would qualify for monitoring without a board order at this point. The board may also ask for an evaluation to determine if there is a substance abuse problem. I would just wait and see what they say, but I know its all going to be alright. Good Luck and keep us posted!

Just got the OIG letter
@Indiana RN my plea agreement went into effect may 1st, OIG letter is dated aug 8. It was to inform me they MAY exclude me and asked for any documentation that mitigates me not being put on there. I have 30 days to send my response which I sent in today, I wrote a letter explaining why I believe I should not be put on there and everything I am doing with IPRP. I also stated my license has NEVER had any action taken against it and was renewed until October 2021. I sent along my RMA so they could see everything required by IPRP and that I am being monitored for the next 2 years, PRAYING THATS ENOUGH.

Just got the OIG letter
@Indiana RN yep been in monitoring since October 2018 full compliance, bon renewed my license no probation. I informed the OIG of this in my response statement. hopefully they will decide not to put me on there but IDK. you said your charge was obtaining a narcotic illegally. mine was obtaining a narcotic by "fraud or deceit" don't know if the wording of my conviction had anything to do with it although I suspect it did. I wish I would have had my public defender ask for a different "wording" on my conviction.

Just got the OIG letter
Does anyone have experience with OIG...they sent me a letter saying they are considering putting me on exclusion list and want me to submit documentation on my i shouldnt be on the list. What should i be submitting? I got convicted of a misdeameanor obtaining a narcotic by fraud or deciet and possession of a narcotic. I never had my license suspeneded.

Going back to school while in monitoring
@Indiana I just renewed my license and when I did I self reported my criminal charges as well as my involvement in IPRP. (it was within the 90 day window they give you to report and conviction) When I look up my license the new expiration date shows October 2021. I haven't heard anything from the BON so as far as I know I just have to finish monitoring. I can probably find a school to go to if my license stays active and off probation.

Getting a job with new misdemeanor
@Indiana I had same charges as Indiana RN but I did not do any jail time, I started INPRP in October and was not charged until December. I think it helps if you start earlier. Everyone case is a little different but I do know getting in INPRP as soon as possible is the best way to go as it will be inevitable if you story is similar to ours. :) It gets better!!!!!!

@Indiana RN so when yoh hit yes to one of the renewal questions there is a an area where you can explain any positive response and you can upload any documetation as well. So i attached my final order of my convictions, i got a copy of my rma faxed it to my email and uploaded it. Then i had to write an explanation as well. I would send all that if I was you too and just explain youve already been before them...nothing new has occurred other than your criminal case was settled. And if you have anything saying youve completed probation i would send that too. I highly doubt they will have you come in again once they realize theyve already dealt with you. Lol
