What are they?
Experienced Phlebotomists or nurses that draw blood will have until 4/9/06 to obtain a state certificate. There is a three year grandfather clause. So i think that everyone will be rushing to obtain a certificate unless paid or volunteer on the job experience acquired between 4/9/98-4/9/03. Will this effect alot of people. I am just starting out in the phlebotomist career.
Facilities usually jump into the picture and give classes to staff when there is a need or demand from the state.
Who thought up this crazy rule?
One thing for sure, if the facility teaches you and the lab has a call off, then the floor will be stuck doing the am collections, and whatever else the facility demands. I smell problems here. We have had a time or two when the sticker could not get the blood and we would use a butterfly and obtain it, we just left it in for another IV site since these patients were fragile and needed many different treatments. Once or twice, in bad weather we have been asked to get a specimen or two to help out, but this will cause some people to lose their jobs, and why not. With the staffing ratio set, you all have plenty of time to do the lab draws on your patients.

RNs WILL NOT be required to obtain this certificate as we are LICENSED by the State and that covers us for venipuncture. It's included in our LICENSURE and included in the Practice Act. (Now if your license is not active, of course you can't do it).
LVNs who are not IV therapy certified will probably need to obtain this cert or the IV therapy cert.

AB 394 is clear. In acute care unlicensed personnel including nursing assistants may NOT perform phlebotomy or finger sticks unless employed and clinically supervised by the clinical laboratory. Certified is not the same as licensed. RNs and LVNs are licensed.
..."one group of employees that we are not sure about are the nursing assistants who are performing skin punctures for POC testing. This group of employees are not lab employees, but their skills are regulated under the laboratory license."
