license issues

My company has decided they want me to possibly work under my own license like an independent contractor. I carry liability insurance but i'm not sure this is smart. In TN in order to provide personal care you have to have a Personal Care support service license, which will not allow for mediction assistance. It is an independent living facility but the company I work for is providing private pay services such as med assistance, baths, etc. since the above license has been put in place, we have a problem. Anyone have any ideas. All are appreciated. :stone

First will they be paying you as an independent contractor, or still as their employee? If they are continuing to pay at the same rate, then they are supposed to pick up all of those insurance costs. That is their responsibility. But I would definitely carry my own liability and malpractice.

Alos, check with the laws where you are and with your accountant. According to the IRS requirements to function as an independent contractor, you need to be set up either as a corporation or a LLP. I am not sure what the requirements are for your state. You would need to check with your corporation commission for that info.
