The H1B visa is designed to be used for staff in "speciality occupations", that is those occupations which require a high degree of specialized knowledge. Generally at least the equivalent of a job-relevant 4-year US Bachelor's degree is required (this requirement can usually be met by having a 3-year degree and 3 years' relevant post-graduate experience). However, professionals such as lawyers, doctors, accountants and others must be licensed to practice in the state of intended employment – e.g. a lawyer must generally have passed the relevant state bar exam.

hi guys, i want to know what are requirements to be qualified in noncap working visa...i passed nclex and ielts an has 1 yr experience (ward area). and can u give me an agencies here in the phil who is offering a noncap h1b visa.. or a direct hiring agencies in the usa... thanks a lot guys!!

I think your answer has been answered, for a specialist which you don't have with your one year experience. The good news many other countries will look at you application after you have 2 years experience. Sorry no short cuts at this time.

In case that you have not been watching the news here, there is a economic downturn that we have not seen the likes of in my lifetime. There has been almost a 25% drop in the 401-K portfolios just over night and this the retirement fund that most have, where they invest their money for when they retire.

In order to get a non-capped visa, that requires that you have specialist experience for the visa to be legal as a start. The facility also needs to prove that they cannot hire an American at this time and this is going to be almost impossible to do. The US government is also in the process of investigating each and every H1-B visa as they were designed for specialists and only about 11% have been used in that fashion.

Things are a mess here right now and do not expect any type of visa to be available. There are tight restrictions on non-capped visas as well, and they are only thru a university-based hospital. Being a new grad or even with a year of experience is still going to be considered a new grad for working here in terms of orientation and that most definitely is not a specialist.

several people i know were hired under the h1b noncap and are now working here in the US with an accompanying greencard petition by the same employer. they are fresh grads too with zero experience. this same facility is set to bring in more nurses to the US within the next few months, and when i asked some of them how this is possible, they said they would be exempt from the lottery system, and the retrogression itself, because it's all under the uncapped category. it seems too good to be true...they are definitely not qualified under the specialist category suzanne and silverdragon described here. so most likely there's some sort of fraud involved? that's a pretty scary situation to be in if you ask me. better to wait and be sure you're following the correct/legal process. it's tempting considering the fact that you get to earn dollars already, but with fraud involved, i'd rather not be a part of it.
