It doesn't matter. If you were required to report and didn't- you submitted a fraudulent application.

I totally agree. But my understanding of a sealed record was that it no longer required me to provide that information. It was sealable die to the fact that it was so long ago..

Too be completely honest. Having a fingerprints and background check done and lying on the application would be stupid if I didn't think my sealed record held up

They haven't denied my application. It's still in review. I can think about a lawyer if it needs to go to a hearing.

I suppose OP didn't really ask a question just a very limited-option poll.

I would agree, the BON in question will determine what is or is not a sealed record/felony. Unfortunately so many of these inquiries don't write follow ups here on AN so I'm not sure what happens in these cases. You could be the first.

Being that the felony was filed so long ago and it was not a violent crime, my guess is that you would have been cleared by the BON. Sure you would have to jump through extra hoops, but it's a small price to pay for that mistake that you made.

Do some research before completing any applications to see how deep they check your records and what files they have access to next time.

So here in Cali we are still required to submit supporting documentation on a charge, even if its been expunged. Do you remember what exactly the application in your state says? Because if you were suppose to report it and didnt, it could be a problem. I really hope you get it all cleared up. All applicants with any type of record are reviewed, so hopefully your ap wont be denied. Best of luck to you!

with that said, the funny thing about the BON is that they pretty much exist outside of this whole..legal/judicial thing.

so they kinda play by their own rules which pretty much says "we cant force you to tell us what you have sealed but...if you dont wanna tell us, we wont grant you a license"

seems like thats where you might be at this point..

This is ABSOLUTELY incorrect. At least in my state, the BON has access to sealed records. However, an employer won't see the sealed records.
