When does a contract become null & void?

I'm a new grad NP who got her first job around September-October last year. My contract states I get paid twice per month but it's already January and I've only received two paychecks.

The clinic keeps coming up with stupid excuses and I'm sick of it. However my contract also states that I have to stay for at least a year or I pay a fine.

I really want to resign but I'm worried they'll make me pay the fine which is like $20-30k just for leaving before my one year is up.

Does my contract become null and void when they themselves don't pay me on time as written in the contract? Do I need a lawyer to intervene? Has anyone been in a similar position?

you are contracted to be paid for services rendered and if they have not lived up to their part how can you be expected to honor the contract. maybe draft a letter stating you expect to be paid according to the contract and if they are unable to fulfill their obligation you leave.... no one can expect you to work for free. my advice GET OUT

Agree with Ollie for the most part. Regarding the letter however, I think that you should contact a lawyer in your area familiar with labor practices in your state.

They've already broken the contract. But as others have stated, you need to contact an attorney.

You can also contact your local Labor Department. If you are not being paid your earned wages, Labor Department will get involved and you will receive all your back pay pretty quickly.

Like above post stated, contact your state labor dept ASAP. Heck, I would have been on the horn after 1 week of delay in pay. You might be able to save yourself contract attorney fees if you contact labor dept first as they are bulldogs when it comes to this. If you do hire labor attny be sure to build into your suit being paid back all the fees you had to pay your attny.

I forget that lawyers cost other people money :) Have had Legal shield for like 15 years. I agree with others with that in mind... Contact the labor peeps.
