im not sure how many of you are aware of this but a vanderbuildt nurse is under trial for homicide based on a medication error. the state is prosecuting her and I don't feel that's right. besides if this trial is won by the state it will open the door for prosecution of nurses for many things that we aren't really responsible for . so for a school assignment I created the Vaughn act. here is the information , look it over and tell me what you think... vaughn act.docx

There are several threads on allnurses.com regarding this situation. I have moved your thread to nursing student assistance.

Please do read the other threads about this particular incident, and then read the actual CMS report. You may find your opinion changes- mine did.

No it won’t. The first criminal charge for a med error was back in 1998. Since then only one other nurse has been tried. She pled guilty and served no jail time. Additionally the Tennessee Department of Health which is the umbrella organization over their BON did investigate and decided not to take her license. You very badly need to read the CMS report rather than getting your information from The Tennessean. The criminal charges are just and it would be very beneficial for you to get a handle on the difference between an honest mistake and egregiously sub-standard nursing practice lest you find yourself in the same situation. Your Vaughn [sic] Act has no merit.
