We now know that retrogression has started for EX Visas (Schedule A) and that lobbying is taking place with the hope that bills will be passed into laws in November 2006 and if not then in March or the latest is hopefully May, 2007.
For those with a priority date (I-140 started) of October 1, 2005 or before they will still get there green card.
(Mine was Feb 2006)
So am I right when I say they have run out of visas and are trying to have a bill passed to stop the cap on the number of Schedule A visas???????????
Do the numbers start again on a certain date or is that it until a new bill is passed????????
Anyone with any more info or advice would be great, my file have been in London for two months now and we really thought we would be on our way to FL early in the new year.
Thanks

i think it is very difficult to find out the truth of it all to be honest, i didnt think that priority dates effected the amount of visas available, the way i understood it, it was to to with availability of visas once your processing was with the embassy.
my file was with London 12 weeks before i got my appointment, so yours may still be on its way.
of course i may have this completely wrong, i wouldnt be suprised!!!!!
all i know is its very confusing and very stressfull for everyone

First, thread moved to the International Forum where it pertains to something that all are interested in. And not specific to UK nurses.
Now to clear up some things.:
Visas are actually issued quarterly, new numbers are added. For nurses that were born in the UK, the number of applicants has not outnumbered the number of visas, at least currently.
For the nurses that are from the PIC countries as well as Mexico, there are many more that apply than there are visas available. That is why the back-log is five years for them until additional new visas are issued, like they did with the Schedule A.
If you are from the UK, you will actually find things getting completed faster once the new visas come out for the quarter. Just sit tight.
And as far as anything gettign approved this month with new viss, do not hold your breath. The entire House of Representatives is up for re-election and they do not go into office until mid -January, then there are more pressing issues that need to be taken care of........Remember that creating a visa for a foreign nurse is not high on the list, it does not solve staffing issues immediately.

Hi Suzanne
Do you know on which months the quarters falls and visas are released?
Every three months, do not remember the specifics.
But if you remember back to the retrogression of last year, those from the UK were getting the entire process done in less than eight months or so. From submission of the I-140 to the visa to travel to the US, Feburary to August, if I remember correctly. Adn they were in the US working.
For those that took longer, it was because of issues with their agency, not for any other reason.
And if you look at any of the verbage that has come out from different attorney's offices over the past few days, you will see mention to visas coming out and not being used up for specific countires. It is not written in bold, and just blends in with the rest, but is there.

Hi Suzanne,
My name is Tomi and i am an Australian Nurse affected by retrogression. Do you know if the number of applicants has outnumbered the number of visas issued to nurses from my part of the world?
Also, i am very new to this forum and would like to ask about who you are, and what you do? (No disrespect intended) Thank you.

Were you actually born in Australia, it is based on where you were born, even if you moved there when you were one year old. They go by birthplace.

Also suggest that you take a look at the Primer at the top of this forum, it may be of use to you.
How far along ar you in the process?
I am the Moderator of the International Forum, as well as the NCLEX forum, among others. I have been preparing foreign nurses for working in the US for years, actually also own a school overseas doing the same thing.
And no, the number of visas is not exhausted for your country.
Thank you Suzanne,
I was born in Sydney and have lived here my whole life.
Im currently locked into a contract with O'grady Peyton international. Im finding it very frustrating when dealing with them... They seem to feel that nothing will happen in terms of green card interviews until the first quater of next year. My priority date is april 26, 2006. They (OGP) have also issued me with a revised contract, basiclly making me more liable in terms of money if i breach. They have also added some small 'sweeteners' into the contact which gives it a less insulting tone.
Do you have any optimistic views or advice for me??
Are there any other nurses out there in a similar position???

How far have you gotten in the immigration process, the PD tells me nothing at all. Has your visa bill been paid, and have you completed the DS-230?
This is already November, next quarter is less than two months away.
Sorry, but they are well known for issuing a revised contract and expecting you to sign it. They do it all of the time, and I truly wonder if they have ever submitted the revised contract to USCIS to be checked out.
Remember that your I-140 approval was based on the original contract. Andsoory, but a $45,000 cancellation clause is truly obscene, as well as needing a guarantor to sign. It only means that too many have tried to get out of contracts with them.
And I wonder why that is.
I have paid my visa bill.
I have submittied my DS-230 Part 1 to the NVC.

Hi Suzanne!
Apologies first, it is months since I was last on, and it seems I only use it when I have a problem!!!! Sorry!!!!
Anyway, me and Ann are in the same boat. My file completed on the 7th Sept and was sent to the embassy, 3 weeks after Ann, so was waiting til Ann heard something then I would be right behind her! But, yesterday I discovered the 'retrogression' and I feel like I have been punched in the face! Why had nobody told me? I have sold my house etc. living in rented and due to move out.......long long story!
So, I am ringing the embassy in the morning to gets some answers (hopefully) but, I was wondering Suzanne, in your very wise opinion , what do you think will be the longest time we will have to wait? ANY advice you can give would be MUCH appreciated!!!! :banghead:
Thank you!
Oh, PS: Ann, I will let u know how i get on, will ring u if I find anythin out!
