retake to CA BON or apply to another state?...please help!

Hello everyone!

Please help me with my case;

1. I'm 21 y.o with H4 Visa and valid until 2011,my lawyer advised and will help me adjust my status to student visa.

2. I took my NCLEX with CALI BON app and failed for my first attempt.

QUESTION:

Since I will be on a student visa, what steps shall I take first?

1. File my reapply application form for CALI?,,,they are asking for SSN***,will i write N/A or just not continue to fill the form?

2. What are the latest requirements for the NCSBN for test takers or repeat test takers?

3. Try another state board of nursing,start from scratch?

I'm really confused and i just found out i still have the opportunity to stay here in usa legally, but i don't know if i have still chance to take NCLEX for the second time.

Please help me.

Do a search on California requirements here on this forum. There is a ton of information here regarding California requirements that you will find helpful. I can't really answer the question directly but I can help point you in the right direction. Good Luck

H1 is a dependent visa, does this mean your spouse is not American? Nobody on this board can give legal advice I would follow what you lawyer told you. I am assuming that you know H1 you can't work any way so why not get more education ?

My dad is the original H-1B holder, thus i was given with an H4 Visa(dependent daughter under 21).when i arrived here in US i was 20 y.o.

H4 visa privileges are as follows;

1. Study to any US university.

2. Adjust status to permanent residency based on employment through dad's H-1B.

3. Multiple entries in the US.

provided you don't reach age of 21 y.o,you should have adjusted your status.

I'm a foreign BSN grad. I took my nclex but failed.

Can I still retake even though I don't have yet SSN?my application is CA BON.

I think your lawyer was trying to tell you the only way you can stay past your 21 birthday you have to qualify on your own merits.

You do not qualify for H1B on your own merits. There is retrogression which means there is a line of people who have already met the qualifications and found an employer waiting. School would be one way to stay, but the purpose is for you to return home after completing your education.

Sorry, this should have been explained to you prior to coming to the USA and you could have taken the NCLEX at home.

I suggest you follow your legal advice.

This is tricky since most of the Universities or Colleges require a current license. Some even require a year or two of experience.

To answer you other question to immigrate to the USA you will be put into the retrogression line. If you get an Advanced Practice License you may be eligible for a H1B Visa. Or if you get experience in a specialty in demand.

So back to your original question. I would retake the NCLEX with CA BON as you way to sit for the exam. They will not issue you a license due to the fact you don't have a SSN. But once you pass the test you can explore our ways to get a license. Last getting a license won't let you stay in the USA.

Yup Maam! I don't really intend to stay here in US anymore due to the fact of my legal issues.I will leave the US in a timely manner.

I will not adjust my status to F1 Visa anymore since its only a waste of time,money,effort. I just realized it.

But it's a great thing to know at least that i have still a chance to retake nclex not here but back home instead..ryt?or maybe i'll try state of texas because my parents lives here.I'll just start from scratch.:)

My plan right now is to go home and apply to another country to gain experience,luckily i have an aunt nurse there and she'll help me. Since my parents are still here,i'll just wait for them to petition me in the future even if it will take years.or just visit them.

I think they can only petition you if you're under 21 years of age. I would check with your attorney to see what they say. Remember that California will destroy your file if you don't provide them with a social security number within 3 years. Keep studying for the NCLEX, and always have a back up plan. Good Luck

I know that they can petition me it will fall under family based-second preference.Unmarried sons or daughters can be petitioned regardless of the age.

I'm also aware that California will destroy my file, it's still impossible for me to have SSN due to the fact that i'm not an immigrant as well as to the fact that their is a retrogression for nurses visa.

I can still file another application for Nclex maybe on other state(even if it requires CGFNS and TOEFL) and take the test later on.

But instead of waiting for me to have SSN, i'll make use of my time to gain RN experience.So that if given a chance to come back here I'll be prepared.
