Resident causing problems

:confused:My husband and I work as LPN's at a long term care facility. Recently one of our more problematic residents got mad at myself, and unfortunately another nurse I worked with forgot to do his tx, but had signed the TX book. He decided he was going to get me in trouble by telling everyone I falsified his record and didn't do his tx. That weekend he told everyone (my husband included) that he was going to get me in trouble. Well monday am he went to the DON and told them I did not do his tx on friday but of course it was the other LPN who did not do it. He then changed his story to my husband did not do his tx all weekend. They are now reporting this to ODH despite the fact that the other nurse he worked with thru the weekend was with him (Had to have 2 to roll him) and states the tx was done. I am so mad because he is outright lying because he could not do something he wanted to do on that Friday and he was mad at me. Now my husband is going to be investigated because of me. Any advice??

This is what your husband needs to tell the attorney. A nurse attorney can be found through The American Assn of Nurse Attorneys. Your husband should get an attorney immediately. His best interests are in making certain that the resident does not railroad him and his license with the help of management at your place of employment. Best wishes.

Do not be too surprised if this whole matter is cleared up once you stand up to this

trouble making loud mouth. The facility will not want you standing up for yourself, but once you do, they will be happy to work out a arrangement with this patient. Oh, look for another job. They will have an axe to grind on your neck. Good luck.

I'm sorry, but I have a question. At your facility, are tx not signed/initialed and dated? I don't mean in the TAR, but on the medipore, duoderm, transpore tape, etc? That would cut back on the whole "Mr. So and So's tx wasn't done." Just a question.

The tx was a topical cream, otherwise it would have been initialed and dated. This resident has a hx of trying to get staff in trouble. I believe he does this to get what he wants. If staff is scaredof getting in trouble he gets extra care. His bath typically takes an stna 1 hr to do and involves at least 2 aides at times thru out. He is a 60 .o. quad by the way who is completely oriented.

If I were the DON and the nurse in question did not have a history of problems, (not doing treatments etc....) and the Resident had a history of not telling the truth (you said he was problematic) I would sit down with the nurse, and the resident and get this mess worked out. I would change the assignments so that the nurse did not have to work with the resident any longer and I would make sure that it was documented WELL! But, I am not the DON....so I would probably get an attorney if my facility management was not going to stand up for me, and I was going to be reported to the board for something that I was not guilty of....

Any pt with a hx of this kind of behavior I would have a witness with me when I do care. I would also document carefully.

I think in order to sue he'd have to prove damages. To just claim that you or your husband didn't do the tx isn't enough because then it is his word against yours. But if there are damages- wound not improving etc, it would mean something,

Can he prove that you had some reason to try to hurt him? It isn';t enough tosay that he was trying to set you up- there has to be more. I would also have a psych consult on him. Is he paranoid, take meds that can cause paranoia?
