thanks all for your nice suggestions. I-140 processing time is almost the same for three service centers right now, but not in last year after the lifting of retrogression. there is nothing wrong with the file, attorney or petitioner but processing delay. By the time the documentarily qualified file was finished in NVC, no visa numbers!

if you are the one whose I-140 got stuck in one service center for 9 months, there is nothing wrong with your file but a precessing delay in some service center, while somebody filed half a year later than you got the visa which was suppose to be given to those who filed earlier, what do you think? you still feel it is reasonable to let the later one get the visa? I don't have any resentment to any applicants who got the visa, everybody tried so hard on their way. but remember, people are created equal! priority date is the most fair and square way USCIS and NVC can balance the visa allocation up till now.

Rep: thanks very much for the explanation! your insight to this is greatly appreciated! this 50K went quite differently from EB3 category in that it was not determined by priority date, but by whoever's DS form is finished first in NVC. generally 3 steps matter in getting a greencard by CP. what matters most is the first step--I-140 approval, which differs from less than one month up to 9 months from different USCIS centers. it is frustrating to see your file lie in one service center for 7-9 months while others finished in a few days, then by the time your file reach NVC, visa numbers are used up! Had the 50K schedule A been allocated by PRIORITY DATE, it would have been more fair and square!

if you think I said anything aiming at you, GOOD, go ahead and think this way, it is yor right to control your mind. BUT, I would like to mention the following things and hope you can explain to me: 1. Why is there a different I-140 processing time in 4 USCIS centers? 2. Why there is a PD date set for Nov. Schedule A? 3. Why in civilized society, peope need to queue? 4. Do you think it is unreasonable to let the early bird get the food? BUT save for later comers? I am not criticizing anybody but put up a suggestion!

i wish uscis can develop a more fair and square way to handle cases. it is ironic that on the same page, somebody's pd date is 4 months later than you has had an interview and got the visa. some even spent less than two or three months for greencard. i feel angry and sorry for you. :angryfire :angryfire :angryfire

this is "the early bird gets the food". you are scheduled because there are visa numbers, but it doesn't mean you will be 100% guaranteed you will get visa. if by any chance you fail the last step during interview, the visa will go to others, some unfortunate applicants will miss the visa.

first one, 2-6-06, it is the date when USCIS received your document, not the date of I-140 approval.

Need some advice
you keep saying that there are no visas for next month, do you really mean that? from nvc bulletin that says something different from yours, there is a cut off date on nov. from oct.1, 2005, and bring the number to 50,000 by then. if as you said, " only another few days", then why don't nvc just erase sch.a from visa bulletin next month? the lawyer explain the same way as the nvc. issue: the schedule a workers category has become oversubscribed for november and a cut-off date established to hold number use within the 50,000 numerical limit. it is expected that demand will bring allocations up to the program limit during november. once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables. how do you understand this? thanks very much!

great thanks to all for your reply! I am still waiting for my P4. the good thing is that my PD is before Oct.1, 2005. Hope I will be scheduled in Nov. provided there are still visa numbers left. try to stay away from those bad agencies as far as possible. they are blood suckers! :deadhorse

While NVC only sent me a letter saying my case was transfered to embassy. no mention of any visa number reserved. I hope they did. my lawyer said visa number was issued at the interview. Suzanne4 said they usually reserved a visa number from NVC and embassy simply issue the visa. I am confused.

agp_ph and Leis 23: I want to ask both of you, have you received a letter from NVC saying that you are reserved a visa number? according to Suzanne4, if you do, you are safe; if not, start from Nov, you need to have a current PD date.

thanks a lot, joinRNMD! I am still not quite clear about the 50,000 and PD date. do they still use the remaining 1000 in Nov. until it finishes and Schedule A will disappear or there are some other souce of visa numbers? will the PD date remain slow moving as other visa categories late on? my PD is Sep. 2005. case transfered to embassy, now waiting for P4. will I be allotted visa if I am scheduled in Nov? your idea is very important to me!

Rep: does your sister have CGFNS certificate? I have the same situation, I want to let CGFNS send my CES but not sure CA accepts it or not. any idea once I have CGFNS certificate, am I qualified for CA requirement? thanks very much!

suzanne4: I have NM license, I need to endorse it to CA, can I fill up the form of License by Endorsement? since I need to send nursing school transcripts to CA board to get permanent license, I have CGFNS certificate, can I ask CG to help me send my school transcripts in stead of asking for my nursing school to do it? since CG has already reviewed my transcripts. once I have CG certifiate, does it mean that I meet the requirement of CA license? thanks very much!
