California Board of Nursing Confusion???
Hello All, I just want your opinion on what do you think is happening on my case. I am a foreign nurse in the U.S. right now under immigrant visa. This is the second time that I took the NCLEX-RN for CA-BON. I believe that I have submitted and met all the requirements in the CA-BON including SSN and was declared eligible to take the nclex. I took the nclex last Jan 12, 2007. Until this date I have no clue what has happened to my papers and have not received any results or online updates. Most of the people that took the NCLEX-rn for CABON who are U.S. residents were able to receive their results within 1 week or only a few days after taking the exam. Adding more to this confusion is that I called CABON and they told me that they mailed that results to me last Jan. 16, 2007...well I confirmed it twice that they in fact mailed the results...I waited patiently for 1 week and there was still no mail. I was advised by the postman to reconfirm CABON if they really mailed the letter. The postman said that it would only take two days to receive the mail... I called CABON, and inquired about the status of my case, CABON told me that they have received the results of the exam last Jan. 16, 2007 but DID NOT MAIL THE RESULTS YET... and said MY STATUS IS PENDING... (When I first failed the NCLEX last year, CABON immediately mailed the CANDIDATE PERFORMANCE REPORT after two days from the exam date and a notification that I i failed the exam, I was able to receive my results within a week that I failed my nclex exam) What I am curious about is that why is my status pending, PENDING APPLICATION would mean that it would be subject for review or further evaluation by the CA RN Board... Well definitely I presume that if in fact I failed then they would not have to worry "pending" my application... They would have to send me a big envelop and a CPR and a retake appplication... 2nd confusion, if I was declared eligible to take the exam and that means if ever I pass I am eligible to receive a license...well unless my credentials are being reviewed??? I really don't know... From what I understand, the moment your test ENDS...the computer/pearsonvue already knows whether you passed or not... PEARSONVUE claimed that the test results are automatically transmitted electronically to NCSBN... in that way this is the reason why is there a quick results for some states... In fact CA-BON has access to this electronic data or in someway NCSBN send these test results to the nursing boards electronically within 2 business days. So all nursing boards receives test results quickly from NCSBN and the nursing boards already knows if a particular candidate passed or failed... In conclusion and I want your opinion; what do you think happened to my case? Is it pending because my credentials are being reviewed by CABON before a license can be issued to me? (and it means that I pass the nclex-rn???) OR... I simply failed, but if I failed why is it that they have not yet mailed the results or why is my status still pending??? clear my confusion... ZATHAN

Hi youknowwho, I took the nclex last jan12 and they told me that they mailed the results last jan16... I believe that I have submitted all documents my problem is that my name is not showing on the online license verification! I am so scared that I did not make it... Do you think that they would have updated that online license list if a candidate has passed? zathan

How long before you got the results? They told me that they mailed that results last January 16, 2006 but my name is NOT on their website. I am so scared that I did not make it. Is your name already on the website and a license has been issued already to you? please reply thank u

Agencies and contracts -- revisited
Hi Suzanne, I would just like to ask would it be possible that a Hospital would change the duty/work schedule of nurses from a 12-hour/day shift of seven days per pay period to just 8 hours/day of 10 days per pay period? We have a contract that we should work only at seven days per pay period with a 12-hour shift. If they would change our schedule this would decrease our salary because they would cut our overtime pay. If we have a complain for the hospital, where would we seek for help or file for a complain? NVC Case Created: November 22, 2005 (Documents were lost and sent to the National Archive DUMB LAWYER she was not able to monitor) Visa Fee Bill SEnt: November 28, 2005 Visa Fee Bill Received by LAwyer: December 22, 2005 Visa Fee Bill Paid and Recieved By St. Louis: January 6, 2006 Packet 3 out FROM NVC: January 6, 2006 Packet 3 Received by LAwyer: January 18, 2006 PAcket 3 out from LAwyer: Jannuary 19, 2006 PAcket 3 received by NVC: March 9, 2006 DUMB LAWYER used the wrong address in sending files...it took 7 weeks just to mail these docs... T.turnbul, I was reading your previous post and you had an approval within 6 DAYS which is really odd. I never knew anyone who has that kind of FAST APPROVAL from the USCIS. There is really something wrong with your application... ZATHAN

to anyone interested in my confusion
I do not agree... Since you passed both CGFNS and IELTS you already have a CG Certificate and a Visa Screen Certificate. Look for an employer in the U.S. who is willing to sponsor you under Employment Based Immigrant Visa. Under the U.S. Immigration and Nationality Act you are eligible to be sponsored AND TAKE NOTE NURSING EXPERIENCE IS NOT A REQUIREMENT UNDER THE LAW. YOU JUST NEED TO BE CERTIFIED BY EITHER CGFNS OR NCSBN in order your petition to be filed. Just look for a good employer. Preserving a priority date which is earlier is the best option. Remember 50,000 visas will soon ran out for nurses. While waiting for the approval of your petition you can take NCLEX. The sooner someone petitions you the better! Most of the facilities in the U.S. are different from the Philippines. You can have you own training here. Some of the nurses I have met claimed that they have 10 years of nursing experience only to find out that it is Clinical SITTING Experience and not actual work experience in a competent hospital setting. embassy interview
Interview appointment dates are being SCHEDULED BY THE NVC, and not by the U.S. Embassy. Due to the volume of cases that were being processed (take for example the US Embassy Manila which is one the world's biggest visa issuing post) it will take more than 3 months to have another interview date. RETROGRESSION for this year?
It was officially announced by the DOS VISA OFFICE that Schedule A visas numbers will be exhausted at the first quarter of the fiscal year 2007 which would start at October 1, 2006. Even if your papers are with the U.S. Embassy if dates ROLLED BACK because of retrogression and your priority date is not current you will not be able to get a VISA... this is what happened last year before the 50,000 relief were given to nurses. FILIPINO Nurses WILL find it hard to Make it in the US next Year, is it true?
Actually it was officially announced by the Department of State Visa Office that Schedule A visa numbers would be exhausted around the first quarter of the fiscal year 2007 (which would start at October 1, 2006). It only means two things 1. cut off dates for Sch A will roll back depending on the DOS VISA OFFICE predictions or 2. Schedule A will be deleted from the list and nurses with a Bachelor's Degree will eat visa from the normal EB3 pool which is backlogged for 5 years in the Philippines. That is why we need a comprehensive immigration reform. This is not a LIE. Do the math if Schedule A visa numbers would be exhausted AND IT IS FOR SURE IT WILL BE EXHAUSTED! and no bills were enacted to be laws for the relief of nurses...THEN EVEN IF YOU HAVE COMPLETED ALL THE EXAMS...THEY WILL ALL EXPIRE BECAUSE OF THE LONG WAIT...and your American Dream will be a frustration! You are not guaranteed a visa even if you have an NVC number. An NVC number is not a visa number or a visa. You must have packet 4 at least or an interview schedule. 2nd Doom's Day for Schedule A is coming unless a bill is passed! ZATHAN...

Well what then will be a Philippine nurse doing in the U.S.? NCLEX is offered internationally example is Hong Kong which is alot cheaper and no visa required. Well ofcourse if you're friend would want to skip the immigration process and start to work there and not JUST TOUR. just my opinion...

NCLEX, CGFNS, All English Exams time frames has nothing to do at all with the immigration process. Although passing these exams are the requirements to start the greencard process, applying at them doesn't do anything or preserve anything. If visas for Schedule A you will be facing almost 5 years of backlog depending which country you were born. If the DOS Visa Office predicted that these Schedule A visas will be gone by the first quarter of fiscal year 2007 and then only those waiting for Packet 4 on these dates will be accomodated. If your papers are still waiting at the USCIS to be adjudicated you better start to worry because chances are history will repeat itself. It doesn't matter too if you have a tourist visa because if Schedule A rans out, you will not be able to adjust status. Chances are you will take the risk of getting "OUT OF STATUS" or going back to your home country. The solution to this matter is a comprehensive immigration reform. There are bills currently pending in the U.S. Congress that would give relief to all Employment Based applicant and possible eliminating retrogression. Please check www.shusterman.com for information about the pending bills in congreess and what you can do. I also endorse www.ImmigrationVoice.ORG it is a non-profit organization whose primary objective is to eliminate backlog and retrogression for all EB applicants through lobbying efforts for pending bills in the congress to be passed.
