OIG exclusion list

I'm looking for ANY info on OIG exclusion list related to a criminal conviction NOT a licensure issue. PLEASE comment if you have any info on this

Yes criminal convictions can get you on the OIG list. These in felony and misdemeanor convictions that are classified and Crimes or moral turpitude (Fraud, certain drug offenses, substance abuse or trafficking) check with your attorney to see if your case qualifies

@hppygr8ful I've already been sent a letter stating they are considering excluding me (due to a misdemeanor for obtaining a narcotic by fraud or deceit) and asked me to send in info that I want considered before making a decision. This was early August and I haven't heard anything yet so I'm wondering how long it takes them to decide.

You can always search the list at https://exclusions.oig.hhs.gov/default.aspx

I would suggest checking monthly until you are sure they haven't excluded you!

Question.. can the AG office still try to put me on the OIG exclusion list even though I don’t have any criminal charges? I admitted to diverting lortab from home health pts from back in 2015. The DEA contacted me and I hired a criminal lawyer. The DEA never did arrest me or anything. Now that then nursing board is having me to pay a 500.00 fine plus put me in monitoring I’m wondering if the Attorney Generals office might get involved. Because on my settlement proposal it states I admitted to diverting lortab from my patients . When it’s signed it goes to all the federal data bases

Does anyone have experience with this? Thanks!

What if my board order states “stayed suspension “. If I am compliant with my order then I won’t be suspended

When I entered the KARE program, my license wasn’t suspended prior to or after signing. I was “just” required to work with the usual 5yr contract restrictions (no narcs x 1 year, no supervisory roles x 3years, UDS x 5 yrs, NA or AA meetings 3X/week, etc., etc., etc.).

I specifically asked about the OIG/AG. I was told that they would not be involved because of no criminal charges/convictions & my license remained active. However, if I relapsed during the program, I could face a move from the compliance side to the disciplinary side of the BON. If that occurred, I could face license suspension which is reportable to the OIG. At that point, I would be on their list & not be able to work at any facility that accepts MCR, Medicaid, Tricare, & VA payments.

So if only certain convictions & suspensions/revocations are reportable to them, I believe you’re in the clear.

To ease your mind, I surfed the internet & found this definition of a nursing license “stayed suspension”.

Stayed Suspension:
The Board has temporarily set aside an order with the understanding that that the order will take effect if the licensee fails to fulfills certain conditions or if the licensee once again violates the Nursing Practices Act.

I’m NOT an attorney, so, please, keep that in mind! I’m not giving attorney advice. Just trying to help you figure things out, as we do for each other on this site.

That said- My understanding is that the suspension is NOT in effect, unless you don’t comply with your settlement/contract. Obviously, it’s not suspended if you’re working. However, if you don’t meet your conditions, the suspension order WILL become active, thus reportable to the AG.

You can ask about this tomorrow, for confirmation.

Thank you for the info! What worries me is I am on the disciplinary side. My board order will be public . All I can do is take it one day at a time and comply with their requirements.

I tried to get into my states nurse recovery program and I never got anywhere , not sure why but I’m here now and it is what it is. I’ve been in recovery for 3 1/2 years , relapsed March of 2018. Now I’ve been sober almost 18 months ??.

So I’m very thankful to be given a 2nd chance . I’m praying I won’t get put on the OIG list- I’m asking about that tomorrow in my meeting. Hopefully if I comply with everything I won’t be reported.
