nurses visas? all used up?

I am a nurse from tha philippines. I already have my visa certificate. Last month I received a letter form the national visa center informing me of my status.. Included is my petitioner's name, visa case number etc. My priority date is october,2006. Now I have heard that all visa for nurses were use up.. Now Im wondering if this will affect my application? Do you have any idea when will the I-140 visas will be available again?

I suggest having a good read on this forum on retrogression as that is what has happened. No one at the moment knows how long it will last but hopefully things will start moving in the next few months

You are already in packet 3. Your I-140 was already approved that is why your case was already transferred to National Visa Center. Your case wouldn't be transferred to the National Visa Center in the 1st place if your 1-140 petition wasn't approved. You should congratulate yourself that your on packet 3 already (I'm presuming you already submitted your DS-230 forms).

The next step is packet 4, w/c is the Medicals and the Interview in the US embassy. However, you won't get to packet 4 until retrogression is lifted.

All you have to do is just wait for it to be lifted (more visa appropriated).

You should be happy. The moment it gets lifted you will be one of the first ones to be lined up for it. Congrats !!

Hi Babymel. Just want to ask where did you file your I-140. Is it Nebraska or Texas? I've heard that Texas is faster than Nebraska. thanks.

Her petition was most prob. have been transferred to Texas. Texas processes more or less in 2 months time. Sometimes even less than a month if done in a month where there was a low workload.

All I-140 petitions can only be filed to Nebraska 1st then Nebraska has the option to transfer it to Texas or keep it. Immigration lawyers don't have a say on where it should go.

The basis for w/c petition stays at Nebraska or gets transferred to Texas is unclear and they do not say it to the public. But I'm sure there's a good reason for it.

hello babymel, my pd is also oct. 2006 (I-140) filed in nebraska too. i keep on looking at the USCIS case status. however, the current processing dates for schedule A nurses is june 05, 2006, but urs have been approved. does it mean that they dnt follow the processing dates posted? im just wondering.. i hope my I-140 will be approved soon.. congrats!!! tnx

No, the dates serve only for guidance and not real-time.

Are you sure it's in Nebraska? Does your case # starts w/ LIN-xxxxx ? or SRC-xxxx ?. If it's LIN- then it's Nebraska and if SRC- Texas.

yes lawrence, coz my case # starts LIN. my exact pd is oct. 26, 2006.

Nebraska is really slow compared to Texas. A friend of mine whose petition was filed somewhere last June-July 2006 was only approved 3 days before X'mas and as you search some threads here you will notice posters whose petitions who were filed last Aug.-Sept. or so aren't being approved yet or just starting to.

so how many months do you think will it take for nebraska to approve I-140?

My I-140 was filed last August 1,2006 and up to now no approval yet.
