You may need to define "holiday pay". Are you talking about pay for the actual hours worked, or an extra number of "holiday" hours awarded as a perk?

If it's the latter, each employer can set their own criteria. In fact, they don't have to offer it to anyone under any circumstances.

What you're describing does sound to be inline with the typical policy of employers who do offer it, though.

Where I have been the 24th would be the holiday for P-shifters. You did not call in that day but you called in the day before. If this is the case, the way your payroll person tried to describe it isn’t exactly right but the result is the same. You did not work the night that you were scheduled before the holiday shift for which you were scheduled.

I would guess this is why some people don’t try too hard to declare themselves well enough to work the holiday if they’ve already been unfortunate enough to 1) be sick and 2) lose their chance at holiday pay before their holiday shift arrives.

I worked Christmas Eve into Christmas Day (Christmas Eve being my scheduled day and then worked the next scheduled day after the holiday.)

It seems like they're often not aware, as this comes up every year. There are always a few people who disqualify themselves without realizing it ...until they get their paychecks.

Christmas Eve was your holiday. You did not work the shift you were scheduled immediately before that. Check your policy. I have never worked anywhere that 12/25 was considered the holiday for night-shifters. They get screwed whether it’s their holiday to work or not. If it isn’t they will be scheduled on 12/25. If it is they will be scheduled 12/24 overnight.

Some places try a little harder than ^ that, but it certainly hasn’t been uncommon IME.

4th paragraph/line: ”If any employee calls off the scheduled day before or the scheduled day after the holiday is celebrated...” — the most likely thing is that they added “is celebrated” to indicate that they are referring to the dates/timeframes in which *they* “celebrate”/recognize/pay the holiday. If this were not the case then a distinction would be unnecessary and everyone would go strictly by calendar dates.

The “Please note” paragraph reinforces and gives more detail and, as suspected, indicates that “holiday” actually begins on the night before the calendar date (@2300 or whenever the “third shift” begins).

This could be made more clear (if they had given even one example it would be completely clear).

But let me ask you this: Was it your understanding that Christmas was your holiday to work this year? And if so, did you also work the 6-6 on 12/25?

6p to 6a on the scheduled day before the holiday, which was my Christmad Eve. I was off on Christmas day after 6a, also thursday, and friday, and back for the weekend (my next scheduled day, which I worked.) The whole time I have been there it has never been like this. It has always been you work the scheduled day before your holiday and after your holiday and you got your pay. The morale is extremely down at this place of employment and they mess with our pay constantly. I work the same hours every pay and always shorted at least 100 to 200 dollars. This is not just me, it almost happens to everyone. They also withhold pay stubs and do not give bonuses they promise. One time I was the only nurse in the building for 3 hours with a census of 75 and 2 admissions arriving. The RN supervisor is also put on a med cart at all times. The place is a zoo! So not only do I do CNA work (due to always being understaffed and call offs.) I also have to pass meds, staff, when someone falls (which is 75% of the time, I have to tend to that.) Along with our frequent pain pill people, drawing blood in the morning, helping LPNs, census, admissions (which all come at night.) Etc.. etc.. I could go on and on. I think I am just mainly upset because I feel they treat us poorly. I think I just need to find another job. Very depressing. Thank you for helping me understand.

Sounds like too many problems to put up with for much longer. Being shorted on earned money (aside from this holiday misunderstanding) is completely unacceptable.
