Foreign Nurses backlog over?

Hello,
Some sources say that with regard to Foreign Nurses Immigration to USA will come back back noraml mode by April or May.
Is it true? Can anyone give some latest inputs in this regard?

The "backlog" as you are calling it doesn't cover only nurses, but technical visas as well. That is what has caused the backlog.

Things should return to normal by July, hopefully, but there is no guarantee.

US Immigration works on the quarter system, so things can change at any time. But since you are new to this forum, I will give you the same advice that I give to everyone else. Worry more about getting your exams completed and getting your Visa Screen Certificate requirements done, than the actual immigration.

Things will work out for you this way. There are no quick fixes available.

are there efforts on the part of congress to exclude foreign nurses in the visa retrogression? thanks suzanne4

No, definitely not.

There is actually a different type if visa in place at the moment, but you must have the Visa Screen Certificate in hand to apply for it.

It is called PERM. You will need to speak to your immigration lawyer about it.

This retrogression is not limited to nurses, but also technical workers that fall under the same category. So it is not just picking out nurses.........Computer people as well.

I already have my visascreen since May of 2003 and my petition is already approved last jan. 10, 2005. do I still need to apply for the PERM?

I thought PERM was just a new way of filing the labor certification portion of the green card. As nurses are Schedule A and therefore exempt it doesn't help plus it still doesn't affect those nurses caught up in the EB3 retrogression.

Yes PERM is the new process for Labor Certification, it will start from March 28. Since nurses fall under Schedule A, they dont require labor certification, and no need for PERM.

Yes, PERM is not a new type of Visa, but a way to speed up the labour certification process. Nurses wont benefit from it since nurses are exempted from Labour Certification part of the GC Process. If my understaning on PERM is correct, Perm may affect nurses negatively, Since it will lengthen the queue (increase the demand ) for a Visanumber as more non-nurses will be soon eligible to stand in the Visanumber queue. Right now, since the LabourCertification process is a 3 year process, there are less people who are eligible to stand in the Visanumber (I140/485) queue. If, if implemeted successfully, PERM will shorten the Labour certification process to 3 months and add more people to the VisaNumber queue.

Again, my understanding is PERM has some (negative) after effets on Nurse petition (I 140) as well, since the employer (attorney) has to file some more documents like Standard Wages Docuement (or something like that) as part of the petition. Previously nurse Employers (Hospitals) was not required to do that for a nurse, but PERM adds that complexity.

my I-140 petition was filed january 26, 2004 and was approved january 10, 2005 under the professional or skilled worker category, do I belong to the schedule A category too? thanks

Nurses belong to Schedule A.
