2 other children not given a visa....

Hello everyone I need your opinion on something, my cousin was petitioned by an agency and is already here (USA). She came here (USA) ahead of her family but the thing is not everyone were given a visa. Only her (a nurse), her husband and one child were given a visa. The other two visas were held for the reason that she need to pass her NCLEX. She came here (USA) as an immigrant in November took the exam and passed. When she sent her result to her husband to show it to the consul they said that they can no longer give the visas to her other two children because of the retrogression.

Should they have all been given a visa when they were interviewed? if not it should have been issued once she has shown proof of passing the exam. Please anyone share some light on this matter...

to me it sounds very strange that they only gave 1 of 3 children visas, I can't say I have ever heard of visas being withheld on account of needs to pass NCLEX first

In fact, who held the other children visa? Is it your agnecy?? or consulate?

Something sounds fishy, is this what USCIS told her, or her agency? Were the other children actually on the DS-230? If they were, they would nave been assigned a visa number at the same time as the rest of the family.

Something is not adding up here, and I do not think that you have all of the information. And how old are the children?

It was the embassy who withheld their visas. Their reason for doing so was that she still havent passed her NCLEX and her fee for training will only be $10/hr which they (embassy) said would not be enough to support them if they will all go. Training is for 3 mos and will only be getting the contracted pay after accomplishing the training. The children were included in the DS-230.

I heard a story about a nurse whose visas were put on hold because she has a big family to tag along and is not a NCLEX passer yet. The consul told her to pass first the NCLEX before he will release the visa. It seems the consul mentioned to her that the salary offered is not enough to sustain a family..

Is the agency WESTWAYS Staffing?Ive attended their seminar and thats what they give... $10 an hour "3 months training" even if you are an nclex passer. But after training you get the rate that you signed on. But frankly .its the first time I"ve heard something like this...giving selective visas!

Yup, WESTWAYS staffing gives $10/hour on 3 months training and I am now on a training under them. This really surprised me about the visas being withheld by the USCIS. I'm just hoping that it won't happen with my 2 kids. It scares me to hell!

Sorry, but the the US Embassy is beign smart on this. That is the wage that you can get working at McDonald's and shame on the agency for that.

If the nurse has passed the NCLEX exam and has a license to work, why in the world would they agree to work for a contract like that. Makes abolutely no sense at all.

That wage is not enough to feed and house a family of five in the US. It may sound like alot to you, but it will not get you anything here. It is almost at the pverty level, especially if you are getting taxes out on top of that.

And in CA, that is outrageous. Why would someone agree to work like that? The agency is getting paid much more than that be any facility.

you're right suzanne, but it just happened that when I did pass my nclex, retrogression is about to start and I don't want to wait for another months or years to be able to be sponsored. I tried going to the hospitals for direct hiring but unfortunately it's so far away on our place and I did compute all my expenses if I'll be working on them and it turned out that it's not enough especially my 1 kid is here with me. The hospitals that are near on our location are accepting nurses only with 2 years experience which I don't have. Time is running out so I decided to sign up on an agency. With that salary, we have free housing privileges and our training is MED-SURG and TELEMETRY. I am willing to take this option for the betterment of my family. Anyways, 3 months is okay and time flies so fast.

Retrogression will not last forever!

I'd bet money by the end of this very year it will be history. I have no inside track, but these things are cyclical.

It might seem like this is an opportunity now, but at $10 bucks an hour, that agency is taking advantage of you.... AND THEY KNOW IT!

I understand you haven't passed you NCLEX, but if you had stayed at home, studied for your NCLEX while doing menial jobs, you would have made out better in the long run. Even cleaning rooms or in odd jobs you would have had your family near and could have pulled together to survive for just a bit longer.

When retrogression does end, folks will come on through and be making 3-4 times this amount WITHOUT the contract of an indentured servant.

I hope I don't sound harsh. I really do feel for your plight. I know what it is to be poor, homelesss and have no money both inside the US and in another country.

It's better to be poor in a house of peace than have "perceived" riches in a house of discord.

Thank you sunnyjohn! I did passed my nclex already and I know that the decision I made was not that good - for you, for others and for me, too (sometimes) - but that we who made the decision will be the ones who will be responsible for it. That's why there's this amazing website (allnurses.com) that will give insights to others that they won't be following the same paths/mistakes again.
