Hello. First post and I am sure I will get a bunch of feedback. Quick history. I had an arrest 5 years ago for a misdemeanor involving alcohol. Did what I was told and it got dismissed. Nursing board of AZ still wants to come after me. I cant fight it because I am back in my home state and would have to get out of state attorney. I have been practicing in my home state for last 4+ years. They finally want to do a hearing and come after my (inactive) license. Should I go through the hearing process with a letter to them (to answer charges again) or just surrender? My attorney in my home state says surrender it and we will deal with my home state's board if and when it comes to that. I do not plan on returning to AZ and frankly don't care what they do but I don't want it to affect my current license, obviously.

Surrender will follow you forever. I would address it with the AZ BON and deal with it NOW.

You were not convicted? Charges were dismissed?
I would not surrender my license for that. Dismissed charges means not guilty. So why should you surrender?

I think you are getting bad advice. Talk with an attorney in your current state about the effect of surrendering a license in another state. You may lose both licenses.
Surrendering may get you on the OIG list as well.

My take on this, is the board has some new attorneys that need work. Is this their first contact with you concerning this issue?
