Suzanne: what is your take on this? also if the visa number is current at the time of filing I 140 , does that allow a person to remain in US & work until I 485 get approved.

does any one know the validity of EAD issued (months/years) as part of I 140 & 485 approval. It seems that i can have an EAD with in 90 days once i file my papers. But if i have an year of OPT remaining and if the new EAD validity if for the same times frame, does that make sense?

I have come across lot of good institutions where they don't have an existing policy / practice of sponsoring, so get a feel on this from HR.

if you have a existing undergraduate degree then you can opt for an 12 to 18 months accelerated BSN program.

Hi Suzanne, From taking a cue from your previous posting, I was able to convince one of my prospective employers, to pay for the lawyer on my own for my sponsorship paperwork, while the hospital pay me the sign-in bonus. I had this lawyer for my H1 paperwork. But he is inexperienced in Nursing immigration. Do you have names of any good lawyers which you can refer? The hospital is asking me a 2 year contract from the day of issuing green card. Is this normal? Also what do you think the penalty for breaking the contract would be? Thanks again..

I am applying for the NJ license and they need background check and finger printing before we sit for our test; there is agency does this thru state board for a fee. I think in NY the employer does this before they hire you, if it is not mandated as part of license. I think for visa screen just need your bsn/ assoc transcript. no need for toefl info. Did anyone know any hospitals who is presently sponsoring in New York city area? I reached couple of major ones known to me and they are not sponsoring at the moment.

The same thing happened to me but I did mail them an application along with the fee and ask the school to send a transcript. I didn't send any of my previous TOEFL / degree / secondary school details since we are exempted from educational review....hope they don't ask for that. Did your state board require background check before test?

Thanks a bunch! so the employer can file I-140 and I-485 Adjustment of Status with nclex.....great relief! I tried the online application but I am stuck at the license information / certification screen and with out that it won't allow me to progress or pay the fee. I can only print a transcript request page from that. I gus I need to mail the application with the fees. Also what is the current EB3 processing time, I am worried whether the retrogression on visa umbers going to impact by the time I start (march/april 06). thanks/ mano

Thanks a lot Suzanne! I was under the impression that they need only school transcript for US educated nurses, to start processing the visa screen. I have applied for OPT before my graduation and it is under processing (about 45 days). Now that I have cleared the exit exam, I am waiting for school to inform the state board for testing. Would you recommend sending a postal visa screen application + $325 fees , and asking school to send transcript, so that they can start the process subject to pending license info.? The nursing recruiter at local hospital told me that they can't start the filing process without the visa screen certificate. But you have mentioned that the employer can petition me for the green card with an Adjustment of Status filed on my behalf before the visa screen. At what stage do they need Visa screen certificate? thanks/Mano
