Thanks for the advice, yes I also under the impression that working visa option is not a good way to immigrate permanently. I am at the stage of checking criminal record with CRNBC, not yet in Canada. Could you tell how long it took you? And most important, how do you look for a job offer - through health authorities, specific hospitals, agencies or all? Are agencies good to work with? Thanks.

Retrogression Is Not Over
If you are submitting just updated information that was actually requested by USCIS, and not just by your attorney to have to resubmit, then they will accept that. If they did not ask for it, then they will not be accepting it; that is what will determine what will happen with your case. All DS-230 forms expire this month, so all will need to be updated. The issue becomes when USCIS asks for it officially, this is the only time that it can be sent in and accepted. That is what would be in your favor. And something that you should ask your attorneys. Just one comment: it is not USCIS who asks for DS forms but NVC. It takes about 2weeks-8 weeks for the approved petition to reach NVC from USCIS.

Dear All! That the window for the 'relief of retrogression" is very small is clear. What are your predictions as for the dates to which the cases will be thrown back when retrogresion hits again? Last time it was 5 years back, am I right? Also, the new visas become available every quarter or how? Thanks.

EB-3 to EB-2
The employer mentions something regarding "home care department" which might prefer Master's. What exactly is meant by this? Is it good or bad? Also, the last visa bulletin says that EB-2 is in currect © processing. Does it mean it is not under retrogression? Just to make sure all my moves are not for nothing. Thanks.

Hi, all! I made some inquiries. To qualify for EB-2 category, you have to get a job offer requiring Master's gedree (in case you have Master's degree). In most cases RN position in the US does not require that. So, even if you might have Master's but you decide to work as a nurse in the US, you category is EB-3 and under retrogression now.

EB-3 to EB-2
Dear Suzanne and Lawrence! I am the wife of the retrogressed nurse, with case approved in August, 2006, fees paid, under EB-3 category. Among many other problems our employer-sponsored lawer made in the last 2 years, I think, there was this one: they did not ask (and we did not volunteer the information) that my husband has M.Med Sc. degree (Master's not in nursing though). Plus 10 yeas of experience in nursing. Probably they could petition us under EB-2 category. My question is as follows: according to your knowledge, is it possible and worthwhile to change now from EB-3 to EB-2? According to April visa bulletin, EB-2 is in current processing, while EB-3 is retrogressed. How is it done and do we risk anything by trying to switch from one category to another? The lawyer does not give us any satisfying answers - just does not want to move his finger. Thanks a lot.

Hi, Suzanne! What do you mean by "hundreds of bills like that"? On one hand, it is encouraging that so many efforts are done. On the other hand,it is frustrating because it means that so many efforts achieve nothing. And why don't they just introduce a separate bill for recapturing visas or nurses, and not amend it to some other bill - the technique that is less successful? (Naive questions). How long do you think it will take for the House for example to pass STRIVE or reject it? How long did it take Congress last year to reject the CIR bill? Thanks.

US lawmakers are not first in the line among well-wishers for immigrants
Dear Suzanne! You mentioned that a nurse with Master's can be petitioned quicklier. My husband has M.Med Sc. - not exactly nursing, apart from his Bachelor' in nursing. How can it help? We have our case approved by NVC in August, 2006, bill paid, but stuck with DS forms because of this damned retrogression. Do you think the fact of having Master's (both my husband and me) can help now? And in general, as far as I can see, things are not moving at all with CIR or recapturing visas. We need some boost periodically to keep the spirits up! What do you say? Thanks a lot for the wonderful site, you and Lawrence.

Hi! NVC requested (!) my DS forms on November,10 and they were sent there on the same day. In November, 30 they were returned. I can't explain why and my lawyer says it's because of retrogression. I would also like to know if there are people here whose DS froms were sent to NVC and approved since Novermber.

Hi, everybody! Those who are suprised by the sudden silence of Hammond Law group as for CIR Feb 28 meeting, may look up some information in the site of Carl Shusterman. Anyway, they mention some suggested "legalization" procedures (does not concern nurses) and an approximate date of the bill to be effected into law - Jan, 2008! Sad. More developments are to happen next week, as they say.

Using Student Visa during Retrogression
In response to the previous speaker, my question is at what stage of the greencard petition you and your friends are. In other words, have you applied to USCIS already? If yes, as I was told by my (and not only my) lawyers, they won't issue you a student visa if they know that your final purpose is to stay in the US, and not to study. Moreover, it may jeorpardize your whole case, so that you won't be able to go at all. And I am talking here about the student visa for the wife of the nurse, not mentioning the student visa for the nurse himself.

What do you make of the fact that both wife and husband in the couple who received it are nurses (I have spoken to them)? Do you think it promotes their case in front of others? Hi, everybody! I am the wife of the retrogressed nurse who is as impatient and tortured by long waiting at every step of the process as everybody here. Lawrence and Suzanne, you mention "them" as doing everything possible to attach the nurses' bill or pass a stand alone bill. Please, encourage me into believing that "they" indeed are doing something to lobby the bill: unfortunately, no immigration news blogs say that AHA itself undertakes concrete measures to relieve retrogression. Does it? Is there any real action taking place for the sake of the American hospitals and foreign labor force? Thanks, and preying for the solution on the horizon, Marina.

Thank you, Suzanne, USCIS approved the petition on June, 6, 2006. Until then there were several attempts to pass IELTS and refiling the petition by the incompetent or too busy lawyer. We are thinking of Canada direction now, which seems to hide less surprises than USA. Thanks.

Hello, Suzanne and everybody! I am among those stranded in the last leg of the process, my case was approved by NVC (after 5 years of exams, and lawyer's mistakes...) but no invitation to the interview follows. Many lawyers mention prospective CIR as a panacea for the nurses. However, it seems this reform will try to deal with illegal immigration more than with legal one and the nurses were in the legal stream anyway. Besides, the word "comprehensive" implies some big and time-consuming changes which is less preferrable for us than just issuing another extra 30,000 visas meanwhile. What is more, neither seems to be happening now - neither CIR, nor "temporary" extra visas. What do you think of this? Thank you, "A cry from the desperate one".
