New grad residency program question

Back in May I was interviewed and accepted into a nurse residency program for med surg.  I wanted er or or but a) the or did not take new grads and b) because I was graduating in august and the program started in July I would becoming in a month late and only med surg would take late comers.  My question is on my last week of clinicals I was urged to apply to a different hospital for the OR position.  I have a upcoming interview this week.  If I get it which I probably will I want to take it.  My question is that my residency program starts on the 26th if I don't start and let them know I got an offer for the department I truly wanted will my contract be null and void or would I still be on the hook for it? I just don't want to work in a dept I hate for 2 yrs when I can go directly where I want now.

This may be an unpopular opinion, and I don't think it answers the question you asked, but as someone who has been interviewed and rejected, I think it's important to stick with what you have. You took a highly coveted spot from someone who would have appreciated it, and you should honor your commitment. It's not guaranteed that you'll get the OR position, so maybe do a kindness and leave that spot open for the people like me who graduated in May and are now getting desperate.

So for both of the hospitals in question a "new grad nurse" is required to do these programs. I hated med surg in clinicals and did not want to work on that unit at all.  I was asked by the hiring manager for the OR position to apply during my clinicals there which is why I am pretty sure I got it.  I just don't want to be in something I hate for 2 yrs.  Plus the med surg hospital has a policy that to go into the OR your required 2 yrs med surg and then another 2 to 3 in critical care.  If the OR position was an options in May it would have been a no brainer.

Pretty sure, or you know as a fact?  Pretty sure is not "Yes, you have it."  

I would suggest you get ahold of the hiring manager of the OR, again, and let her know your situation. You can phrase it so it seems as if you're on the fence of accepting the other job and ask her if she can tell you would it be more likely than not, you can get into the OR residency at her hospital.

I know you mentioned you have an interview this week,  I'm assuming it's going to be with a few people and not just her.  Do the interview, maybe follow up with her around two days later and ask what I mentioned above.  You never know what the impressions will be on the other people who are in the interview.  She may like you as a person, but what if the other interviewers have other candidates in mind?

It really is going to be up to you to make the final decision. I think after your interview this week, you might have a better idea if the OR position is more within reach than not.

What are the terms of your contract regarding contract termination?

So the only terms I have found regard to terminating the contract pertain to repayment once I start.  My official start is the 26th of August.  Nothing regarding to anything prior to that date.
