You can open and agency whether you are an RN or not.
You can be the only RN on staff and call it an agency, just have the right paperwork for the lawyers (incorporation or some such thing)
You can pay whoever you want whatever you want, although I am not sure about whether the IRS will investigate- they can investigate for any or no reason.
If I understand the situation correctly it all sounds legal to me. Just someone who took time and effort to look into the rules so they would be able to keep as much of the $$ as possible.
If you feel strongly enough you could call the IRS and ask them the same questions. IMO it's the business owners's business how they live their life, not yours, unless they have cheated you in some way.
Any body know about Rules and regulations regarding working for family member and minimum amount need to be paid to family employee?
Why don't you do a search on your computer for it?

As I told you in the e-mail that you sent me, you are better off being the only employee, not working for a ffamily member or you have an additional set of payments that need to be made...............as the sole owner of a corporation it is much easier with just you.
