HIPAA and Ca BRN

Are very minor HIPAA violations reportable to the Ca BRN? My understanding is they are not as the BRN is only interested in violations of thd Nurse Practice Act and if they do get these things they just forward them to the appropriate agency. My employer seems to think they are but my research says no! Thanks for any help from all the wise nurses out there!

What is a "very minor HIPAA violation"? Either way, HIPAA violations are dealt with by the Office of Civil Rights. What is determined by the OCR may indeed affect a license as criminal complaints can be involved. However, depending on the NPA of the state, violation of patient confidentiality may be a violation of the NPA and a reportable offense to the BON.

It was just vital signs and no sensitive information such as.HIV status.Apparently what PHI was disclosed and to whom matters and if the risk was mitigated.It also matters if it was accidental or if it was obtained to hurt someone else.So the nature and extent of PHI matters
