I am a filipino nurse.I came here in Montana last Nov 3,2005.As stated in my contract,i am gonna work first as CNA while i am not yet an RN.Last Jan 4,i took the NCLEX and fortunately passed it.But still my employer gave me a CNA schedule in addition to my RN shadowing.Yesterday,they called me to arrange my schedules for February,and they want me to work CNA again because somebody called in.So i decline and went home.They called me by phone but i was not home so they just leave message that my DON wanted me to call back.When i called here,she wanted me to work as CNA that night,again i refused and i told her that i was not not stated in my contract to work as CNA to cover my 36-40 hours a week as RN.My administrator talked to me by phone and told me that she end my employment and asked me to talked to our contact person to transfer me to another facility or else i am gonna send back to the Philippines. and even told me that i was not needed in their facility.Pls advise me! What i am going to do?

I know at my work, all RN's fill in as PCT's because we are super short on PCT's. As long as they pay me my RN salary which is almost three times that of a new PCT, then I am more than willing to help out and it is kind of a nice reprieve. I don't know if my place of employment would act as harshly as yours did if an employee refused, but I'm sorry this happened to you. Maybe you could sit down with them and discuss what happened. As for threatening you about sending you to the philipines, on what ground????

You may be working as a PCT, but in Ohio you are responsible to function at your education level. You can be held responsible as an RN even though you are on the clock as a tech.

It sounds like your facility is abusing your contract. Did your contract state anything about being required to work on short notice, or in positions you're overqualified to do??? And what happens if you encounter an emergency while you're working as a CNA - if you use your nursing abilities that are above and beyond CNA licensure, then that could cause problems. Sounds like a bad situation all around. Unless your contract states that you may have to fill in as a CNA past nursing school, I would contact a lawyer to see if maybe your contract has been breeched. They may be threatening to send you back to the fillipines just to intimidate you and keep you from checking into this further. Good luck to you!

Congratulations on passing NCLEX. I would definately talk to your contact person about finding another job. Preferably a job that will orient you as the RN you are and not take advantage of you and make you work as a CNA. You didn't go through hell and back, studying for years, waiting for years, and working your butt off to be treated this way. Good luck!

frequently nurses are pulled into a situation when there is a shortage but should not be SCHEDULED to work as an aide
i think that the agency that placed you in this position could help you find some place else..you could go over this persons head but that always leads to bad feelings..better to start out fresh somewhere else

Florida is "at will" state. It basically means you can be fired any minute, with or without grounds.
I knows how you feel, because when I worked at a facility in St. Petersburg, Florida I was just there 2 weeks and told BY PHONE that I was no longer needed. It is against the law to fire someone over the phone!
