Situation:

A nurse had already been given packet 2 and waiting for packet 3. However, many months have pass the packet 3 didn't arrive. The recruitment agency contacted the NVC, then the error have been made, the NVC thought that that the nurse was already in the US and just changing the status. Thus, they didn't send the packet 3 form.

Sounds like something fishy with the agency/attorney, not the NVC. Have seen it happen many times, the agency did not pay the fee for the visa bill and are trying to put the blame on someone else.

And more importantly, there are two differnt sets of documents that are used, only the I-140 is the same for both, but then they become different.

So, if had to make an educated guess, it was the agency's fault, not the NVC. They can only make a mistake if the wrong documents were given to them, they do not make up paperwork.

But I can almost bet that the visa bill was not paid, and that is why the nurse did not receive the packet 3.

Well, Sussane  I agree because my friend demanded some prints from the NVC but the agency can't produce any of it. Therefore, its a pity that my friend who had pass all her exams including the NCLEX would have to wait for another year just because of the suppose "mistake". I would really expect that by the time I told her about this she would really gone mad. Her agency told her such stories for so long now.

This website is a heavenly gift to all of us nurses against people who are trying to use us. I believe the Almighty have some purpose why it happened. My friend just have to practice more patience.

Thanks.....

Just as I said, the agency is at fault, and as I had expected.

Hi Suzanne!

In my case, my agency has been telling me that my paper was already sent to NVC and said it got remarks as requirements complete but no interview schedule as of this time. I mentioned about it in another thread, but just to refresh you the date my agency said my papers was received by NVC was Aug 22, 2006. Anyhow, my agency kept telling me that they have no control anymore as to interview sched once papers are moved to NVC. But what I am interested to know is that what are the documents that we need to see or check from our agency to ascertain that indeed my papers are moved to NVC. All these info I got from them are basically verbal. As far as what they told me, I am in Packet 3, so what are the docs pertaining to the truthfulness of this. I have filled up forms like I-140, DS230, and recently FBI card fingerprinting for my license endorsement to Arizona. I have passed all the required exams (CGFNS, IELTS,NCLEX) already. I even have an employer and they did interview me few months back. I did asked my agency to provide me with processiong dates but still got no word from them as of this writing. I am still clueless. Hope to hear from you Suzanne.

nope. they will just call me up if there are forms to be filled up or sign but i never seen any receipt number. in that case, i need to ask them that. thanks! is that all? are there any pertinent docs i need to ask from them?

angeldust, do you know your NVC case number (MNL2006XXXXXX)? If you do, you can check the progress of your case by calling NVC at 0016033340700. If you don't know, ask your agency for your case number.

PD or Priority Date is the date when your I-140 was received by the USCIS office. Also known as Notice of Receipt/Action.
