It's always an individual's choice. Some got lucky, some don't. There's always life after denial, it doesn't stop there. Everybody's taking calculated risk based on the information they have and the circumstances they got. Some have double degrees, working on H1B as IT professional but also a Nurse, waiting for his PD to become current. Some have tourist visas and taking the risk of denial due to dual intent. It is the risk they take and life they spent. Each has his own path in life.

Another 9 months of full time study to get. It has to be part of your curriculum.

OPT is valid for 12 months only and cannot be renewed. CPT is your next option or off-campus EAD. CPT will take another 9 months, I think. Off-campus EAD is harder to get. Better get H1C if the hospital you're on is willing to sponsor you for that.

The difficult part is UNlearning...if you're planning to work in the US...get the 'right' experience as soon as possible....you will know what I am talking about if after spending two or three years in a hospital with sub-standard practices, you get interviewed and you will realize that those things that you thought was right was actually sub-standard practices.....

I am just trying to get an answer for a hypothetical case and get some possible options if ever I reach the same situation. My question is: Can I abandon my AOS and revert back to CP and still retain my PD? Thanks for the answer.

What if I go back home before the decision is reach, like approval or denial, is it possible to go back to CP and retain my PD?

It seems that the USCIS need this new rule because they cannot catch these illegal immigrants in the past. If they were very efficient in the past and were not being circumvented by illegals, they do not need this new rule. We need stricter enforcement nowadays. We, legal immigrants, are affected by these illegal immigrants. In one way, some will suspect us to be illegal just because of our color, etc.

After going back home, can I revert back to CP using the existing I-140?

I guess most of us here would like to know what options remain once AOS is denied? Is going back home the only option? The lawyer suggested that we can appeal and you said that is wrong. If the lawyer is wrong, then what will be your advice?

I heard that from a lawyer. The only evidence that we can see now is the jurisprudence on these cases. There were AOS denial cases filed in US district courts. Some won, some lose. Did she submit any paper that is dated within 30 or 60 days of arrival? It could be the contract, etc. Is it possible that if someone stayed for too long that the adjudicators presume that the applicant worked without EAD and thus violate the NIV? Just guessing....it is important to learn this lesson.

As suggested above, Hospital is always the better choice over nursing homes. The ratio is high in nursing homes while in a hospital, typically 1:5. You get a better training in a hospital than in nursing homes. You will learn more than these once you start applying for a job here in the US. You will know the advantages and disadvantages of each as an immigrant and as a nurse.

I am talking about illegal immigrants like farmers, grape pickers, etc. These people do not even pay taxes because they are paid cash. Some illegal immigrants uses ITIN to buy cars, etc. Are they not also using other people's name? How can there be a mismatch then if the name and SSN match? Hopefully, this new rule can also catch things like this. I do not like what they are doing but they are doing it.

As I was saying, I am not subscribing to anything illegal. I am only stating some things I observe happening in the real jungle. Not all monkeys are afraid of the lions. While the lions rule the jungle, there are some wild animals not following the rule. It is frustrating to see that. While I am following all the rules, I see some laughing at me, enjoying their earnings from illegal activities. Anyway, I just wanted to show concern to those just starting out. Do not get frustrated if you see this happening once you got here in the future. The world is not ideal. It is not by the book.

I know that it is illegal. It is just that I am sharing what I know and what's happening out there. Not everything is by the book. I know EB2 requirements are not so easy to meet. I know that there are risks of denial. For some reason, they do it and I don't know why. It is also true that some applied for H1B. I don't know if their stories are true but this is what I am hearing from friends and others who I just met. Prediction is prediction. I may come true, it may not. Until the official bulletin comes out, no body is really sure.

Tell me if I'm wrong but my best guess is that they have solid experience and were among the lucky ones to get from the 50,000 visas. And another, they have recruiters who assisted them. Recruiters are just the same as agencies. They make you sign a contract as well. They get the 'money' from the hospital. The situation now is different.

Just make sure you're getting the 'right' experience, not just the number of years. The Philippine hospital setting and nursing practices are very much different from the US. When you get interviewed by the US hospital, you will know what I am talking about. To get the right experience, I am talking about St. Lukes, Asian Hospital, etc.

The real jungle out there is different from what we know and think. Some employers are willing to hire Masteral Degree holders, create position for them, petition them using EB2 (which is most of the time, 'current'), and then let the nurse work as a regular nurse (skilled). The papers are different from the actual but who cares? I know it is illegal and I do not subscribe to anything illegal. But the real jungle out there is not ideal, not by the book.

I hope that they do not wrongfully fire a legal immigrant just because of a simple mistake. Illegal immigrants are not that foolish to be caught. They have too many ways to circumvent the system. Many are using ITIN, instead of SSN. There would never be a mismatch.

That is if you can land a job in a hospital very quickly...that would be good. My experience in looking for a job in Ca. is that if you have enough and 'right' experience, you can land a job in a hospital. If you're just a new graduate and just starting out, it will be very difficult and nursing homes will be your choice. Working for a hospital is always better than nursing homes. Suzzane is right. However, the other side of the coin, is that the quick path to get a job for a newbie? You're lucky if a hospital petition you if you're just a new graduate. It's like winning a lotto. On the other hand, nursing homes will petition new graduates. It is a bitter pill but still an available option. It is entirely your choice. I know someone who after one year in nursing home which petitioned her and after getting her GC, she resigned and landed in a nice job in a hospital with a nice signing bonus. I also know someone who got several years of experience here in the Philippines, landed a job in a hospital in US as well. It's up to you where to get the experience - in a hospital here in the Philippines or in a nursing home in the US. It depends on your circumstances. The choice is entirely yours.
