paying your own petition

hi! just want to ask if its legal for the nurse as the recruit to pay for her own petition (eb-3 for immigration filing fee, lawyers fee, etc.) and reimbursed once in the us?

is this really the practice of agencies or direct hire employers now in the us?

Yes, the nurse can pay for the processing. It is not unheard of and expect to see more and more of it. It is also completely legal. Due to the time before the nurse gets to the US and to make sure that they will begin to work for them. There no longer is any guarantee that one will get the visa, so the employers are just wishing to cover themselves.

The H1-B requires that the employer pay all fees and not take the funds from the nurse when they begin work.

you're right suzanne, the hospital wants a guarantee that the nurse will be coming and will work for them thats why they want the nurse to shoulder the expenses and just reimburse them when they arrive in the us.
