I just needed advice to know if i am on the right track, i will graduate in aug 17 2007 with ADN in nursing, i have not taken the nclex but plan to take in Sept, applied for my opt which will be available after sept 15 2007 according to the school. I have not applied for the visa screen, just to confirm if i am okay this is my plan
1. nclex
2. visa screen
3. look for lawyer
4. apply for job
am i on the right track???? please need your advice. In case i get a job offer and do not have all my paper work processed with in the one year do i have to go back to school or risk being out of status??? Is a private hospital better than government in terms of sponsorship?? I am a bit confused most of the threads claim that it is important not to tell your prosepective employer that you need sponsorship, but won't they realise that when you apply for the job with your ead??? What is the time period in filling for the visa screen, do I have to have it before applying for the job???

Once you have passed NCLEX you are right to apply for vsc. Luckily you have OPT as currently you are affected by retrogression and there are no visas to adjust. I would strongly suggest you tell employers that you need petition for GC. You do not need vsc for job but will need it for immigration so apply for it as soon as you pass NCLEX and arrange with BON to forward results to ICHP usually a small fee is required. Lawyer is up to you but nothing can be started until a) visas are available to adjust and b) employer may prefer to use their own. I personnally would hang on until you have employer willing to petition you and know where you stand.
I would suggest having a good read in this forum especially on retrogression, there are a few threads on this subject and keep an eye on what is happening with it, don't really expect to see some new info until sept/october
