I have been granted judicial diversion for forgery and theft of property. I did not fail any drug test. I violated policy and was arrested for it. Does any one know what my chances are of getting to keep my license even if with probation. I have never been in trouble before and I really hate to loose my license, I have already been out of work for a long time due to this. Anyone been through anything like this. They did tell me that my record would be clean as long as I didn't get in trouble for so long and the judge says I can work but I am still waiting on the board to get back to me.

Too vague. What did you do? Arrested for breach of policy or for a criminal act? You dont have to fail a drug test..i never failed a drug test. Although my actions were illegal. I could guess what you might have done, but that isnt fair to you. I am sorry you ate going through this.

I was arrested for forgery and theft of property what it boiled down to was I violated protocol for the wasting of narcotics. I had learned a horrible thing from others and trying to get done in a hurry and I got in trouble for it. I was arrested and went to court fought as long as I could. I ended up taking judicial diversion which means as long as I don't get in trouble again for so long all charges will be expunged. They say it won't show up on my background check unless I get in trouble again. And as far as the drug test o was talking about I was drug tested few times at work prior to termination and with termination and then with the judge. I just really screwed up and forgot that protocol is important and just cause someone else done it first doesn't make it ok. I was just wondering if I will get to keep my license. I have sent it all in to the board now just waiting to hear back.

so yes it was a criminal act.

In Texas the Board has been known to allow ex cons who have been in prison get relicensure. Keep good records. Show remorse and understanding of wrong doing. And pray. Good luck.

Hi, I'm currently going through the same issue (I live in TEXAS). After I had my baby in November 2014 I had some post partum depression and prescription drug addiction issues. I was so bad into my addiction that I stole prescription drugs from a family friend. They told me that they would not press charges on me as long as I got sober and did better for my family and I. Unfortunately 4 months later the Sheriff Dept shows up at my door and arrests me for Felony Theft. They did in fact file charges on me. I saw my OB who prescribed Zoloft for depression, I went to a counselor and began AA/NA meetings which I still continue regularly. I hired an attorney after all of this happened and was granted "Pre-Trial Diversion" as well for a year with 80 hours of community service. This was all completed this past July 2016 and the D.A. denied my case as if it never happened (NO CONVICTION). I have not practiced since I was arrested because I did not know what would happen to me and I was under ALOT of stress. I also needed to distance myself from my practice for awhile so I could get myself together. I started working for a title company because I needed a job in the mean time.

My license expired February of 2016. I did not renew it before then because I didn't know what would happen with my case.

Last week I sent a letter to the Board of Nursing and informed them of EVERYTHING that happened to me as well as a letter from the District Attorney showing that my case was denied and I was never prosecuted. I'm so nervous as to what they are going to say to me. I am ready to go back into the field. I miss it so much. I pray so hard every night for a good outcome !

Hey guys! I heard back from the Board of Nursing yesterday. Great news! They are going to allow me to do TPAPN ! I'm not too thrilled about it but Nursing is my passion so I will do everything I have to do to get through this ! I will be starting my CEU's soon so I can send them in to the BON when I renew my license and get on board with the TPAPN program and find a job! Wish me luck!
