Hi All,
Please help me with your suggestions. I am BSC nurse with 4 year experience. I have completed the RN , CGNFS and IELTS certifications. My H1B visa was stamped three months back through a Health care staffing company. Unfortunately I am told the hospital that I was recruited is now excess of staff and need to wait for vacancy to come for me to travel to USA. I have resigned my previous job and I am little worried. It's my dream to work in US.
I would like to know..If my H1B visa would get expired or canceled if I don't move to USA in six months after it's issued. Can I enter USA with this H1B visa without the current employer support and find a new employer after reaching there. Please advice me with the options that I have.
Regards
Maxie

hibvisa is usually limited to sponsoring employer to bring in a specialized worker they are unable to find in the us.
the h-1b is a non-immigrant [color=#0645ad]visa in the united states under the [color=#0645ad]immigration and nationality act, section 101(a)(15)(h). it allows u.s. employers to temporarily employ [color=#0645ad]foreign workers in specialty occupations. if a foreign worker in h-1b status quits or is dismissed from the sponsoring employer, the worker must either apply for and be granted a change of status to another non-immigrant status, find another employer (subject to application for adjustment of status and/or change of visa), or leave the united states

it will be very difficult to obtain another employeer at this time as there is a surplus of rn's with bsn degrees these days along with new grads in most of the us.

This immigration issues, not many of us know about it. I think you should contact the immigration office for the answer. Meanwhile, can you try to find work from different agency?

You need to speak to a immigration lawyer as previously mentioned, this is something we can not answer but if you do not activate within 6 months I believe the visa is cancelled because there is a period of time that requires a visa to be activated.
I also think you will find it hard to find another employer willing to go the H1b route and the hospital that sponsored you for your H1b had to provide proof there was a job so not sure how they managed to get round that if there aren't any jobs now
