Fingerprint Background Check

Published

Does anyone know what a fingerprint background check includes? Does it include old arrests or arrests with no charges? Has anyone had a fingerprint background check and had it not include prior arrests?

Also, I know that different states have different laws on this? Will the report be different depending on the state you are in?

Thanks!

Everything!! arrests, convictions, even transfers between facilities..anytime you were fingerprinted will generate in your fingerprint report

The fingerprint background check is FBI level. It will see EVERYTHING. If you have anything on your record, it wold be best to disclose on your application. Depending on the reason for the arrest and if there were any charges, it may not even require much deeper investigation. But if not disclosed, then there could be consequences.

I don't understand why it matters if you were arrested. The application says convictions. If they want disclosure of arrests then why do they not say that?

REPORTING PRIOR CONVICTIONS OR DISCIPLINE AGAINST LICENSES

Applicants are required under law to report

all

misdemeanor and felony convictions. "Driving under the

influence" convictions

must

be reported. Convict

ions must

be reported even if they have been

adjudicated, dismissed or expunged or even if a court ordered diversion program has been completed

under the Penal Code or under Article 5 of the Vehicle Code. Also, all disciplinary action against an

applicant

's registered nurse, practical nurse, vocational nurse or other health care related license or

certificate must be reported. Also any fine, infraction, or traffic violation over $1,000.00 must be reported.

Great question! But I do not have all the answers.. : )

If the application specifically states to disclose CONVICTIONS then you don't have to disclose arrests which did not lead to a conviction. However, they will find out about them and you must be prepared to explain to the BON the circumstances surrounding any arrests. You may also be required to submit official court documents to prove that the charges for which you were arrested did not lead to a conviction. Hope this helps!
