I'm hoping that someone can help me understand an issue I am dealing with. As of now I signed a contract for one OT shift weekly. So that being said I work four 12-hr shifts a week. Here is my issue:
My schedule for the week was to work Monday, Tuesday, Friday and Saturday. So that would normally be 40 hours regular pay and 8 hours of overtime pay.
This is what happened that week:
On Sunday I get a call saying they were desperate and needed me to come in and they would give me call back pay, which is 1.5 times my regular rate. Ok, I go in.
I then work Monday and Tuesday, and have Wednesday off.
On Thursday, I get a call again saying they are desperate again and need me to come in and they will give me call back pay again (1.5 times my regular pay). So I go in on Thursday.
I then work Friday and Saturday as well.
So I have a total of 72 hours. I hit the 40 hour mark on the second call back shift on Thursday, so I thought that Friday and Saturday would be straight overtime pay.
Here's what my hospital did. They did not count either call back shift towards the 40 hour week. They counted Monday, Tuesday, Friday and part of Saturday, and I only got the overtime pay for hours worked on Saturday.
Is this right? Shouldn't the Sunday and Thursday be counted towards the 40 hour week as hours worked regardless of being paid OT for those two shifts because they were coded as call back pay?
