Adjustment of status

Hi everyone,

I am a foreign trained nurse presently in the US on student visa. I have CGFNS and TOEFL. I hope to take NCLEX and TSE next month. I understand that I need the visascreen certificate to adjust my status. I have read from this forum that it is possible to get hospitals to sponsor/petition for the Greencard directly without working through an Agency. I would like if anyone could refer me to a hospital that can do that. I got info. that it takes about 90 days to get the EAD. My question is when the EAD is approved, is my status adjusted automatically? If so, to which type of visa/status

NB; I donot fall under those countries facing Retrog......? I have 14 months of acute care experience.

When you are petitioned for a position and are currently in the US on a valid visa, the Change in Status form is submitted by your employer. When this is accepted by Immigration, you are issued an EAD which allows you to work while waiting for your green card, ninety days after the Change in Status is submitted.

You are lucky you come from a country not affected by the retrogression.

it is very possible to get hospital to sponsor or petition you without going through any agency. in fact, it is more advisable to do so. there are so many hospitals that does that. what state are you in right now?

initially, USCIS processes EAD for 90 days. it is a little faster now, they do it 60 to 90 days. mine was approved on the 60th day per online verification however it took about 10 days to reach me.

EAD is only a temporary document issued to you so you can legally work while waiting for the pending petition by your employer (I-140). so while your I-140 has not been acted upon by the USCIS, you are allowed to renew your EAD. once the I-140 is filed by your employer in your behalf, your status now becomes a 'pending adjustee'.

the processing time (PT) by USCIS for I-140 as of March 10 is 270 to 300 days. it seems that the PT is becoming shorter because the last time i monitored PT last february, it was 350 to 360 days. after I-140 approval, an adjustment of status (AOS) or I-485 can already be initiated. so it is not automatic that your status is adjusted after you get your EAD.

the PT for AOS is now 330 days as of 10 March. it used to be 660 days (last february).

try to over the previous posts by suzanne regarding this matters. it will enlighten you greatly.

Thanks a lot for your response. I am concerned about when to quit school without violating my student status; after obtaing the EAD or when the I-140 is filed ('pending adjustee)? I am asking because where I intend to work/file documents is not in the same state where my school is.

What are you in school for? Anything having to do with nursing?
