The BRN outlines what is permissible during your probation. Kaiser will determine if they are willing to comply with it.

It depends on several factors:

  • Type of probation. What the terms of your probation are will play a big role. If your probation includes restrictions on practicing or working in certain settings, that is a barrier.
  • If it only involves monitoring or specific continuing education requirements, there may be more flexibility, although managers do not like the added paperwork burden.

Reach out to your union representative as soon as possible and consult with an attorney if you haven't already done so. If you are practicing in California, it is an at-will state, and you can be terminated for anything except discrimination.

Hopefully, your previous performance and an understanding manager will enable you to keep your job.

I knew a Nurse who worked in the ICU and was put in the diversion program and returned back to Kaiser and have to drug test 

but she was allowed back to work
