We do not give legal advice here....I suggest you contact a lawyer and you malpractice carrier to discuss this matter. The BON decides what punishment/penalities will be by your history with them and the seriousness of the offense.
BONs scope of authority is related to clinical practice only. If the "work record" issue has nothing to do with clinical/patient care, they may not be interested.
