Terminating a Contract Before Start date.

Published

Hello Allnurses,

I am asking question for a friend who doesn't have a allnurses account. He was offered a job as an ACNP in a town near his prior resident and was moved there by the company. He has been in the town approx 30 days waiting for credentialing which started 3 months ago. Currently he is without work. The other day my friend received an offer for another job in a setting he would prefer over the initial job but it would require him to move back to his previous city. Being that his start date was tentatively mid august pending credential, could he resign and terminate this contract and take the second job where he can start within a week or so. Termination clause in the contract mentions mostly a 30 day notice from the provider but being that the credentialing is still in progress with the potential of maybe another 2-3 weeks or more before clearance would this 30 days matter? He already mentioned that he knows he will have to pay back any money put into his move. Thanks for the feedback!

it sounds like your friend needs legal advice which is not so easy to come by on a nursing site.

I would say your friend needs to talk to the hospital and not strangers on the internet that have no idea...

Have him call the hospital, we have no way of predicting what they will do or say.
