second time to Consulate, no visa number again.

My husband is also EB-3 visa applicant.

He was scheduled for 1/25/2007 interview, he went to the interview and was told to go home and wait for visa number.

On 7/19/2007, he was told to come back to the consulate to continue processing his visa, he went to the consulate, submitted his passport and was told to come back 2 days later for result.

He went to the Consulate 2 days later and waited there the whole aftertoon, however he was told the consulate was closing at 5pm, he has to come back tomorrow for result.

We went there again today and were told there are no visa numbers, he has to go home to wait for visa nubmers.

What is this? It's so ridiculous, we don't live cross the street, we live in a city 2000km from the Consulate. We spent so much time and thousands of dollars for travelling and hotel, and our feelings are hurt so badly.

Feel like we are fooled again and again. Why they informed us to come if there is no visa number? Is this a game? What a shame!

Any idea what should I do now. Is there a place we can complain?

The US has been under a retrogression since last October. They were in the processing of clearing up pending petitions but then were forced to open up to additional petitions being submitted now. This is why your husband's petition got put on hold again.

If your husband actually a nurse or under another category? Nurses did not get placed only in the Eb-3 category until February of this year.

This is something that should be taken up with the US Embassy where you are, but they can only give a visa out if the number is still assigned to your case. Or to the attorneys that just fought with immigration so that they would accept more petitions.

What is his Priority Date? I believe the current PD for Eb-3 for mainland-China born are somewhere in 2003.

With this July flush-in of 485 applications, it is expected that PD will not progress dramatically for many years.

And the above poster is entirely correct, there are many from China that are in the US with the H1-B visa, and are under the same EB-3 category. Many have PD dates that are much older than many. And the number from China that wish to get the green card far exceeds the number of visas that can be issued each year to those from your country.
