refiling

Hi!

My lawyer had to refile the petition - which took off 7 additional months and, I guess, I missed the cut-off date fo rhte present retrogression because of him.

Who knows what is the current priority date for me know - the one with the old receipt date in USCIS or the new, refiled, one? Also, why did he have to refile?

Thank you.

your lawyer should tell you why he has had to refile, there many reasons including not filing properly initially

If the petition needed to be refiled, it means that the original was denies by USCIS and does not exist. New date is what you need to go by.

But the question for your agency and attorney is why were you not informaed of this in the first place?
