Yes, you are missing something and will never get it because it is not happening to you and you want so desperately for he ACA to be wonderful... and it is not wonderful for most people.

I did talk to my employer many times... and the IRS (The agency that issues and collects the fines) and what you say is just not the case. As for PRN only being "as needed" you are wrong again because I and and others were hired as full time PRN's by our own choice because we had insurance elsewhere... but the ACA as written right now makes that impossible. I am sure that will change after the first big north eastern hospital gets it's first huge fine but as it stands right now this is my life... I and millions of other are living what you say can't happen. I know, even after your hospital gets the pants fined off of it that you will still believe what you believe about the ACA. I on the other hand will continue to believe what I believe because it is happening to me. To discuss this further on those grounds is pointless and only leads us to believe the other is stupid in some way. I hope and pray you are right... but that is not what I and millions like me are living right now.

Before the ACA I was hired as a full time PRN. I know that may be hard for some to wrap their heads around but I was hired to work a regular shift but for PRN pay and no benefits by my choice and the hospitals. It was good for me and good for the hospital. Now, under the employer mandate and 30 hr rule of the ACA i loose hours and wages. I loose hours if I stay PRN because EVEN THOUGH I HAVE INSURANCE FROM SOME PLACE ELSE, I will not be allowed go work more than 29 hr a week due to the evil ACA. (Note to the moderator: This is exactly on topic because I am one of those PRN's being screwed over by the ACA). I loose pay if I go full time with benefits I do not need or want. Either way the ACA is a total loss to me and those like me.

You are right, it would be GREAT if a waiver for coverage would be allowed so that the employer would KNOW that they would not face a huge fine for allowing her to continue working full time hours with PRN pay..... but there is not and just like Jolien, no business will risk their business on maybe. I am retired military so do not need the hospitals benefits. I was hired to work full time on a regular shift in the ER but paid PRN pay without benefits. It was good for me, my family and the hospital... AND HURT NO ONE. Enter the ACA and all that is over. I have to choose between a devastating pay cut by staying PRN and working less than 30 hr per week (no hospital is going to let PRN's get anywhere near the 30 Hr due to the hospital closing fine they would trigger), or a very aggravating pay cut going full time working the same hours I work now for less pay. I took the lesser of two very evil options hoisted on my by the democrat Obamacare law (ACA) and went full time with benefits I do not need... and took a second job. So to all you who sing the praises of the ACA, it cost me money AND more time away from my family. I am in no way a fan. Love the though that we can take care of preexisting conditions ... but it would have been much less expensive and devastating to just tackle that problem without lowering every working Americans quality of life. This is not just true of hospitals but all businesses in America. January is upon us. The damage will become much more evident as this next year goes by.

And do you think any hospital is going to risk being fined a million dollars or more just because it dosent address people who are insured elsewhere? The answer is no, they will not risk it. Remember this is a government that survives only on taking money from others and from business. If they have and ambiguous rule they are going to go after the money until "We, the people" stop them. This is not just happening to me but to millions of nurses just like me. I am ensured because of serving 23 years in the Navy. Other nurses are ensured under their spouse and thus work PRN because they do not need the benefits. The ACA is a horribly written job killer.

Once again you are so very wrong... but i understand you wanting to defend the horrible law because you supported it to begin with. It is hard to admit what you supported turned out to attack the nurses at hospitals all over America and it is easier to attack the hospitals and nurses that were hurt than admit the ACA is a crap sandwich for most of us. The ACA has serious job killing flaws and hopefully enough democrats that survived the latest election will see that their end is near if they do not get rid of the employer mandate and the job killing 30 hr rule. I hope you are not hurt by the ACA, and of course if you are in a leadership role it will not hurt you but will hurt the people who work for you.

I called the IRS because they are the ones who will be fining and collating the fines to the hospitals. And you are so very wrong about this having nothing to do with the ACA.... It has everything to do with the ACA. You can say that I do not understand the law all you want and it still does not change the FACT that me and millions like me are being hurt by the ACA right now.

And I have to call B.S. on you. I am a full time PRN working a regular shift in an Emergency Room. Come January I will be forced to either content to work PRN but less than 30 hours a week, or go full time and work the same hours I do now for less money and benefits I do not need. That is a fact of my life and the lives of millions of American nurses right now.

I know it does not make sense... but it is happening... right now... to millions... and all the "it doesn't make sense" in the world will not stop it. This is a badly written law and needs to be scraped and started over but this time try and cover the non covered and leave the ones of us who have been doing it right alone. Leave the job market alone. By Feb all will see what a job killer and quality of life crusher the PPACA is... a law that Protects no one and is not affordable.

That sounds good ... but I and millions like me did not have this problem until the ACA came along. i did read the law and called the IRS on many occasions and never got anywhere because as much as you seem to not want to believe this is happening to me and millions like me ... it is happening to me now BECAUSE of the ACA.

Except needle safety and seat belts did not cut my hours at work and cause me to have to work a second job. I know all of you love the ACA and that is fine.... but for me and millions like me it is a total loss.

I did read karens post and it does not help me a whit. I have been on the phone with the IRS many times about this when I first saw it coming down the pike. I asked them many times to show me where in the law and employer would not be fined for allowing me to work more than 30 hr if I am covered some place else... and other than they telling me "because it dosent make any sense" they could not show me a place in the law that ensures my employer will not be hit with the huge fine for allowing me to work full time PRN without their benefits. You can post every 30 seconds that the law says "Offer" and I will still be in the same boat that ALL PRN's are in .... insured under another source or not ... of having my hours cut. It is easy to say you law is not harming me and hundreds of millions of working Americans.... but that does not change the fact that it is harming me right now... and people at other hospitals, and Lows, and Home Dept, and Wall Mart, and other businesses all over America.
