He WAS an employment Attorney, Yes I made copies of the paper I had to write up that night, and as far as calling the CNA that witnessed the abuse,, I have tried and she doesn't want to get involved in fear they will fire her as well. She said she told them what exactly had happened, and nothing was done,, so she said "where does that leave her?" She was crying over it,, but NEEDS a job! YES! I documented everything, crossed my T's and dotted my i's,, This was jammed into our heads in Nursing school,,, as in CYA!!! So, yes, I knew all this. Also,, he wasn't the first EMPLOYMENT Attorney that I had contacted,, I had contacted 2 prior to him,, one wanted $250.00 an hour, the other said they couldn't take the case because they lived in the same county as this Nursing home. That is why I drove 50 miles to see another Attorney, who by the way when I called and told him my situation said nothing about $500.00 until I wasted all my gas and drove there to see him. This is why I said I have hit a brick wall, I have done everything I can,,, To tell you the truth it sounds like a scam!!! How do they get away with this???? What they are actually saying as far as I am concerned {at least in this State} Turn your head, let CNA's be the boss or you will be fired and chastised at work! MY best friend still lives in New York, turned in a CNA for abuse, and was not fired, or dis-respected, because the facility fired the CNA,, not her. It is Indiana! TY for your help,, but I have tried everything. This State sucks, and I have read about Indiana on here before,, nothing GOOD either! TY again***
  2. I really should tell the truth,, but I just figure they got me and will make something up. I am scared, I did nothing wrong,, but they said {which they made up} I was taking too long to pass meds, and just wasn't working out,, now this is 2 days after I reported the CNA,, so I mean you know it's a messed up rack. I had only been there 2 months. But I as a Nurse was not going to not report it, I suppose I need to call the state to see what to do, or an attorney.
  3. Okay,,, as a lot of you have read I was fired for turning in a CNA for abusing a patient, they kept her, and fired me. Two years ago at the same facility {I was not working there then} a CNA took a patient in the shower room , stripped him down nude, took pictures of him from his cell phone camera, and circulated then around the internet, he was not fired either,, then someone got word of it from the outside, called The State and he was then fired. Well, it has been 2 weeks I was fired,, I have went to several job interviews, and have not been able to get hired anywhere. I do not put down {ofcourse that I was fired nor do I use then for a reference} Now my problem is,, they are all telling me I would not be a good candiadate for a Nurse at their facility because I had stayed home to raise my daughters, and have not worked a while. But I read all these job postings {and I am not saying anything against new graduates} but I read where all these places want to hire, and will train new grads, now as a Nurse for 20 years, when I graduated I didn't know Squat, book smart was it,, we didn't get that much clinical training to walk onto a floor and take right over,, so why are places willing to hire a new grad, but not a Nurse that just wanted to stay home to raise her daughters, and now wants to get back into Nursing? Is anyone else finding it hard to get a job because they took a break for a while? I don't see where this is fair at all,, I was fired for seeing abuse to a patient, {along with another CNA that witnessed it, got fired}, now every job interview I go to, I am being told I was out of Nursing too long,,and wouldn't be able to do the job because of that,,, I don't now what to do,,I am traveling over 50 to 60 miles to find a job so I know the facility isn't black balling me, but I feel chastised because I stayed at home, and raised my girls, I don't understand, does anyone have any answers for me? I need to support my family, my 2 girls are still at home,, just older now, and I am a single parent, Why are they saying there is a shortage of Nurses? I have kept up with everything, meds change everyday,{so you can not even go by that} and to reactivate my license I had to take 3 online exams that are required every 4 years. I didn't forget anything, and I am in shock, I went to Nursing school, and had worked a s Nurse for a very long time before I had my girls, so what is up with this. I am so depressed.   4. I am so down right now from being fired because I reported abuse on a patient from a CNA,, I am not sure what good I would be giving you advice. If you want my input, I think it is all in who you know. I have some hard thinking to do seeing as though the facility made up a lame excuse to fire me for reporting abuse as the head Nurse in charge that night on the floor, gave the Cna 3 days off with pay at that, what a nice little mini vacation she got. I am supporting 3 kids, and she is 55 years old living with her daughter. NICE! Bur here go=es, when I was a Nurse in New York I worked at The VA Medical center,, I was detailed to the pshyc floor a few times, and it had itsups and downs. The men that walked around knew enough to pretty much leave you alone, except for flirting, and the others we gave meds to through a window, okay,, so I should say, Psyc is not one of my speacialties, but it pays good, and I believe a State Hospital would not put CNA's over Nurses. Let me finish one thing about the facility that kept the CNA that abused the patient and fired me. Two years ago, a male CNA took a patient in the shower, stripped him down, and took nude pics of him from his cell phone, then circulated them around the internet. He too was repremanded with a nice paid 3 day vacation,, until someone from the outside found out, called The State, State came in to investigate and that is when they fired him. Says a lot about this facility,, I thought I was doing my job, and lost it for caring. So,, I am not sure what good I am right now giving advice. I still have not found work, I do have 3 interveiws lined up this week, but I have to drive 60 miles to work if one of them hire me. If anyone wants to e mail me I don't care because I can't E mail back on here, becasue I don't have the money to buy the premium membership,, so my E mail is > [email protected]. I hope someopne from the facility that I worked in is on this site and read what I wrote,,, becasue if I was them, I would be ashamed to say I was even employed there. I am even questioning is it better these days to just be a CNA??: Nurses mean NOTHING anymore? I know I was a CNA 9 years before I became a Nurse, and I respected my charge Nurse or any Nurse as far as that goes, and as demanding as the work is,, how would it even enter your mind to abuse a patient?

  6. Oh lord,,, I feel so bad for you also. I am so sorry. Us Nurses seem to go through way too much, I never knew after being a Nurse since 1985 that it has got this bad. I never ever went through this,, I thought it was the state I live in now. Maybe not!   9. I don't carry Malpractice insurance though, I only carried that when I was doing Private Duty care. I don't know what to do because I have been so humiliated I would not want that job back anyway, but I did think the labor board or someone could do something, should I call an attorney? I know those 2 CNA's had to have said something very bad about me,, I never ever was still passing meds at midnight from 8pm meds, what a lie. It was the excuse the facility chose to use to fire me,, they knew I knew too much that was going on there, plus they knew they were wrong NOT terminating a CNA that abused a patient. Something to me sounds very fishy, I re checked every bit of paper work I ever did there before leaving, and took very good care of the residents, and was very professional. I am just so hurt to be accused of something I never did, and fired. TY for answering me.
  10. I am sorry, I put down I was supporting 23 kids,, no I am so upset, I am supporting 3 kids. I really need advice though, I just don't know what to do, I was clearly set up, I was doing my job, and was fired. Please if someone could help, I need to work, and as I said am I going to get a job? Am I going to be black balled for reporting abuse? I am so sick over this. How could they get away with it?
  11. Hi, This is cyndi_1985. I am extremely upset. I need some professonal advice ASAP. As most of you have read I posted a concern about a CNA that verbally abused a patient , I reported the incident as soon as it happened. There was another witness who also verifed what happened. Last friday I went to work,, this CNA was never reprimanded, and I wrote a 2 page write up on her, as the Nurse in Charge. On Friday, she was very defiant towards me, she refused to put a resident to bed who had fallen asleep in the day room, {he had just returned from the state hospital, was total care, had to be T&R Q 2 hours, incontinent} I asked the Cna to please put him to bed. She said "NO, he is sleeping in that chair" I asked her 3 times, and she still refused, {she was the only CNA on my shift all night to 20 residents} so, I am not really sure what she did to me, but I was off the week end, and got a call from my DON Monday, she said she wanted me to come in to speak with her at 1:00 pm,, I told her I was going to call her anyway due to this Cna's behavior on Friday night, she asked what the CNA had done, so I told her, it was not just not putting the resident to bed, it was being very defiant to me the whole night, {as though she had me for reporting the abuse, and not being repremanded} she had another CNA from the 2nd floor constantly coming down to our floor all night, and they were making snood comments to me, going outside to smoke, etc,, infact I left there in tears, knowing the facility had actually given them the okay to over rule me as the Nurse in Charge,, anyway, when I went in to speak to the DON, and the ADON, they told me I was fired. I was dumbfounded, I had done nothing wrong, I had been professional, and they told me they were firing me becasue the residents were not getting their 8pm medications from me until midnight. I told them that was not true at all, and that they were finished being medicated at approximately 9:00 pm every night, {they also make you START YOUR 8PM MEDS THERE AT 6PM}I in no way ever gave residents 8pm meds at 12 midnight, and they said the residents had complimed that their meds were not given to them until then,,,, this is a down rright lie. There is no resident in that facility that even has any sense of time, and as I said the meds were always given by 9:00pm. The 2 Cna's on Friday night, definately had it in for me, and I don't know what they could have made up to get me fired, I am at wits end, supporting 23 children, no job now because I reported abuse, and I don't know what to do. My License was on the line if I would not have reported it. From what I understand 2 years ago {I was not employed there then} a CNA took nude cell phone pictures of a resident in the shower, circulated them on the internet,, was reported and never fired either,, until someone from the outside called State, they came in investgated then the Cna was fired. Also, the facility does not make Nurses keep their CPR up to date, I was the only Nurse on nights that had an updated CPR. I know I am going to have to report this, but then will I not be able to get a job anywhere? Now, I have to try to find a job at least 40 miles from where I live, because this is a small town, and there are no jobs here, I called yesterday to every nearby place I could, and no one in this town is hiring. I am ready to give up Nursing, I am severely depressed because I only was looking out for the residents, and I am the one that was fired. This is hard for me to even write. If anyone wants to know the name of the place I am not ashamed to give it. I have been a Nurse for 30 years and have NEVER ran into this. I have never been fired from a job,, I am so upset. What are they telling this CNA? That it was okay to abuse a resident, and over ride a Charge Nurse? Do Cna's get to boss Nurses? I always worked in New York,, this is a very laid back town in Southern Indiana, I am scared to even go to work as a Nurse around here. The facility from what I understand {as I said has been investigated before} Please if anyone has any info let me know. I have been crying, and actually physically ill for doing my job, and getting fired over it. It is insane, and not legal. They lied, I was a good Nurse there. Cyndi Thank you
  12. I too am going through the same thing, I just posted it. I am sorry this has happened to you, small town, night shift,, all the same, I too was told Don't mess with the CNA's,, well I am The Charge Nurse and I will not hear a CNA abuse a patient and let it go,, but then your the dog for saying something,, I can't go anywhere else to work,, I would have to be at least 60 miles away from home, I am a single Mom with 2 Teens I leave, and work 12 to 14 hour shifts, 3 to 4 days a week,, I do not know how the facility could get away with protecting CNA's over Nurses. They let them run us. The witness that also heard the abuse was a real good CNA, and she verified every word I wrote down,, but yet the DON told the CNA that was abusing the patient just to write down her side of the story, {her side of the story is: SHE ABUSED A PATIENT} and not the firdst time,, she has been reported many times. I am lost for words, and don't enjoy going to work since this happened, I worked hard for my degree, I am supporting my family, so Yes, I am going through the same thing. I mopved to this State from New York,, this would not happen there. That CNA would be gone, and CNA's are taught to respect the Nurse in Charge, not tell her what to do. Again, I am sorry you are experiencing the same problem.

The town I live in does not have many jobs for Nurses, you need to travel at least 60 miles, this is ridiculous, I have 2 Teens I leave at home while at work, being a single Mom, I need to be near them. Isn't there a place I can go to to find out what the laws are on verbal abuse to a patient? I can not afford to drive real far from home to work, this is a good job for me, and leaving, is not good, and actually to me,, it is letting the facility condone abuse. I moved here from New York, I know in New York a CNA would be fired immediately for abuse. Sorry,, I just am overwhelmed,,, why as a Charge Nurse should I be the one to go? Thanks

I did report it immediately, I called another Nurse from another floor and exspressed my concern, we called the ADON at home, and she said to send the CNA home immediately, and write down what happened, this CNA from what I understand has been reported before by other Nurses for the same thing,, it was night shift, and the Cna was called in the next day along with the other witness that heard her, I understand,, they told this CNA she only had 3 days off, and it bothers me because this is patient abuse, and I immediately reported it, I have a license to protect,, what bothers me the most is: Other Nurses told me the facility doesn't do much, and actually listen to CNA's over Nurses. I am very concerned about this. She has deliberately shut lights off on me while I am passing meds, and also I put that in writing, prior to the verbal abuse I heard , the week before she had to be written up, nothing was done then either. I need answers, I will not let one of my CNA's abuse one of my elderly patients, and yet the facility is not doing anything. I always thought, you abuse a patient ,, you get fired. As I said this is not her first write up for this. She had the patient crying all night, and I would like to know what to do. Thanks
