but even if you have a BSN RN from the US, most nurses are on AOS...waiting...only OPT brand new nurses...I talked to recruiters and they understand tnat a provision does not make sense b/c they looking for experienced ICU and ER nurses... Experinced nurse=saved lives

Talked to recruiter: they do not take AOS people"b/c green card already filed". So what? Does not make any sense....They will ytake any kind of non-immigrant visa but will not take somebody whose 5 steps ahead in immigration process:)+ 5 steps ahead in clinical practice also. + They want basically, ICU and ER nurses only

There is one more RN killed in Afghanistan, i know:(. I got my BSN from US school. My problem is that I am with PD 2006, AOS, and my daughter in my home country-I cannot bring her here until I get a GC. It has been measurable.

AC 21 change employer
I think, Silverdragon, that it does not make sense if immigration does it but there are a lot of things that do not make things we see....I just wanted to know if anybody ever used AC 21 with traveler company? or any hospital or employer? What kind of paperwork is involved?

It sounds pretty bad. I wonder why if they issue the law, and they count it against you? What would be the base for denial in this case? People who use AC@21 do not violate the law, they do not do anything illegal. Does anybody, actually, used AC21? Can travel company be used in this portability law?

Suzanee, thank you so much for your quick replies:). What kind of paperwork? Everything is filed by my first "petitioner" hospital. What I anticipate I will need from them is RFE-job offer. What have you heard about Intelistaff and Country Cross? I 've seenyour posts in travelers blog, do you have any information about them? What do I need for AC21? Thank you so much:)

They accept work permit without any trouble. I've talked to American Traveler, Intelistaff and PPR, -any problems, since I can work anywhere with work permit. My problem is : does immigration care if I work for travel company since it is kind of full time job but not really? Do you know how to file AC 21?

Hi, guys! I've worked in my hospital for 2 years. my contract is up:). My I-140 approved in 2006, and I-485 been pending for more than a year. I talked to my lawyer and she states that I can change my employer any time. The quetsio is: can I work as a traveler nurse for travel company picking up 3 month assignments (full time). Will that be considered the same job since I work as RN and in a hospital settings but through the agency? I would love to hear Ms. Suzanne opinion but I appreciate all of your responses:).

I am from Ukraine which is located right by Russia. Two countries are very similar and nursing profession is the same. There is no RN degree in our countries, 2 years degree is required to be a nurse. Nursing profession is underpaid and they make literally nothing. Hospitals are not "high tech" but mostly 18 th century compare to the US at the most parts of the country. Depends what you are looking for, but I would say that our nurse it is like LPN or even less.

pending RFE for I-485
Yes , I will need to find somebody to sponsor (file I-140). There is a shortage of nursing teachers as well as RNs. ANd it is a primary problem: we ( them) do not have enough nursing faculty to teach. I think with MSN it will not be a problem to find a school to petition for me. They even hire now people with BSN to teach (in some Juco's). EB 2 is current :)

pending RFE for I-485
Yes, I already applied to renew my EAD for next yesr, which is 340 $ now. I am sad b/c it will take so long and Ihave a child at home. I am looking to get MSN in education and change to EB2. Do you think that there is a chence for EB2 to retrogress? I assume if I get into EB2 , at least I can save myself 2-3 years of waiting? there is an accelearted MSN in ed. : 1-year program, so by 2009 I will have MSN degree. Do u think it is worth a risk?

I talked to other lawyers and NSC call center, and after this the picture comes together: It actually does not matter when you file (in general), it is important when they open and work on your I-485 at the last stage (process of making a decision). And, if a visa available at this final stage, you will get it; if there are no visas- has to wait. They do not preassign visa as soon as you file. Therefore, like in my case, which was not open before/in July when it was "current", there is no visa available at this point. B/c of NSC been so slow, I guess, those people who filed before Retrogression but their cases were not processed before August 2007, have to wait. And I do not think it is matter of RFE, it is matter when they adjudicate your case. That's what they told me. Is it right? In my case, they said they are sending my case to immigrationofficer to make a decision and they will let me know. I was trying to get from them how they can "let me know" if there is no visa number assigned to my case and there are no visas available at this poit.Will they write me "we approved you case but you have to wait unitl visas are current?" Sounds absurd. They said also that I can request from them written response to my inquiry on my case. I guess I will wait until :) officer make a decisison.

I called NSC back and ask them specifically if there was a visa number assigned to my case. They said "you case id previewed and what is holding your case that there is no visa available" . I told them that most of the people who filed before retrogression got the visa numbers which they answere "well, there is a chance, call us back in 30-60 days. Tere are thousands of applications." Also, as I understood they do not see it on their screen? Just a frustration.....

pending RFE for I-485
Guys! Does anybody submitted RFE for I-485 and their case pending? I filed my papers before retrogression started to NSC, 26 th Oct 2006. My I-140 approved in August, 2007. Security checked done and cleared. They requetsed some RFE, nothing major (letter from employer) and now case (I- 485) is pending. Anybody in similar situation? Please, post your stories.

Yes, the deal is RFE. We'll see what they have done to our cases. Logically, if they assigned visas to everybody than RFE should not change anything. ALso, I looked up dynamics in Visa Bulletin, and it takes 2 years to move up 9 month. So, with retrogression of 5 years, it will take probably more than 7 ? or 8? And how all the numbers were current for years and suddenly at the end of 2005, they retrogressed 5 years? b/c they changed procedure ? Sad story ahead, anyway.

Thank you Lawrence! I guess I will call them again and ask them specifically if there is a visa number assigned to my case. If there is one, then life will get better :). And I hope b/c I filed before retrogression started I got one assigned to me. For some reason, I had a guess that not everybody who had filed before retrogression started, got assigned visas; and NSC just open cases, work on them and than put them on shelf until visa are available (my lawyer sounds like that). I will check and let you know. BIg thank you for answering my posts.

Dear Lawrence! Would you please explain what does actually "adjudicated" mean? In my case, I have sent them requested documents such confirmation from my hospital that I has been working there and for my husband: his medical-TB skin test was not checked. we sent them back in time, now the they say it will take them 60 days to give us update. It has been almost 60, so I called them directly to Nebraska SC, they said that clearance check done (fingerprints and name check) but there are no visa available. So, as I understand, there were no visa assigned on the first place. But why that they open the case? would appreciate anybody response

Thank you for reply I was on basketball scholarship and had 2 practices a day + nursing school + part time job to pay for rehabilitation of my daughter in my home country. Physically, I was not able to keep up with everything. When I finished my University, my child was not in a country, so was unable to file AOS for her. Now, they opened my case but it is uncertain when the decision will be made- in a week or in 4-5 years. So, I am trying to find another way to make a process faster. Thank you

Hi, guys! I've been reading this website for a quiet some time. Recently, there are no updates to Nebraska tread, I guess there are any news due to retrogression. My PD Oct 26th 2006, I-140 approved in August 2007, than they requested evidence from my employer that about my position and salary (general info). Than ... "On September 13, 2007, we received your response to our request for evidence. We will notify... You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing (already done) have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. There are couple days left and I have not heard anything, and my lawyer said I am looking for the next 4-5 years to get GC. Anybody in similar position? Is it 60 days to get answer or until Visa available? I thought if they opened my case I-485 , I will at least have some kind of update or answer in 60 days period. Me and my husband are going home to visit our family and our child in December. We have travel documents. Guys, how safe is to travel with travel documents? We have child at home and it has been 5 years separate, and according to my lawyer, we cannot file for her until our paperwork is done which another 5 years. Our daughter is has CP and a special need kid. I've heard about Humanitarian parole. Anybody has had experience with brinning your kids while on AOS? Or may be I need to get Masters degree to move to EB-2 or go teach and get H1-B and get for my child H4 dependant? any answers will be greatly appreciated. I do understand that nothing can be done about such a long wait, but it has been so hard without my child and any help would be blessed. ICU nurse
